Permanent Deputy Prime Minister Nguyen Hoa Binh - Head of the Steering Committee for the arrangement of administrative units (DVHC) at all levels and the development of a 2-level local government (LGO) organization model issued Plan No. 40/KH-BCĐ dated April 19, 2025, assigning ministries and ministerial-level agencies to issue, according to their authority, or propose competent authorities to amend, supplement or issue new legal documents (LDOs) related to the termination of the operation of district-level LGOs and the organization of 2-level LGOs.
The plan clearly defines the work content, completion deadline, and responsibilities of agencies and organizations in promulgating specialized legal documents related to the termination of activities of district-level local governments and the organization of 2-level local governments.
According to the Plan, ministries and ministerial-level agencies (according to sectors and management fields) shall preside over and coordinate with: the Central Committee of the Vietnam Fatherland Front; agencies under the Government; People's Councils and People's Committees of provinces and centrally-run cities; relevant agencies and organizations shall review resolutions and conclusions of the Party, legal documents on sectors and fields under the management of ministries and sectors that are effective (including legal documents that have been issued but have not yet taken effect) to assess the institutionalization of the Party's policies and guidelines, legal provisions and issues arising from practice that need to be amended, supplemented, replaced, abolished or newly issued in accordance with the direction of amending and supplementing a number of articles of the 2013 Constitution and the organization of 2-level local governments.

In particular, it is necessary to focus on reviewing legal documents according to the List of legal documents containing regulations related to the tasks and powers of district-level local governments (attached to Official Dispatch No. 002/CV-BCĐ dated April 4, 2025 of the Steering Committee for the arrangement of administrative units at all levels and the development of a 2-level local government organization model) and other related legal documents.
Based on the review results, identify the contents that need to be revised, supplemented or newly issued legal documents to end the activities of district-level local governments and organize 2-level local governments.
Ministries and ministerial-level agencies shall complete the review, propose plans, identify contents that need to be amended, supplemented or newly issued legal documents, and send them to the Ministry of Justice before April 20, 2025. The Ministry of Justice shall synthesize the review results and report to the Government before April 30, 2025.
Based on the review results and opinions of the Ministry of Home Affairs, ministries and ministerial-level agencies shall promptly issue, within their authority, legal documents in the sectors and fields assigned to them for management related to the termination of the activities of district-level local governments and the organization of two-level local governments.
Propose competent authorities to amend, supplement or issue new legal documents in the assigned sectors and fields related to the termination of operations of district-level local governments and the organization of 2-level local governments; issue a decree on decentralization and assignment of authority in the management of assigned sectors and fields based on the provisions of Clause 2, Article 32 of the Law on Organization of the Government 2025, Clause 2, Article 50 of the Law on Organization of Local Government 2025, Article 13 of Resolution No. 190/2025/QH15 dated February 19, 2025 of the National Assembly stipulating the handling of a number of issues related to the arrangement of the state apparatus and Clause 1, Article 14 of the Law on Promulgation of Legal Documents 2025.
The Deputy Prime Minister noted that the content of the decree needs to clearly state the division of tasks, powers, and administrative procedures from district-level authorities to provincial-level authorities and from district-level authorities to commune-level authorities; combined with clearly defining the decentralization of tasks, powers, processes, and procedures for decentralization from the Central Government (Government, Prime Minister, Ministries, ministerial-level agencies, Ministers, Heads of ministerial-level agencies) to provincial-level authorities.
Regarding implementation time, the Plan clearly states: For legal documents under the authority of the Minister and Head of a ministerial-level agency: no later than June 30, 2025 (depending on the scope of regulation of the legal document).
For Government decrees amending, supplementing or newly promulgating or decrees on decentralization and assignment of authority in the field of sectoral management and assigned fields: Ministries and ministerial-level agencies shall proactively draft; submit to the Ministry of Justice for appraisal before May 10, 2025, and submit to the Government before May 30, 2025.
The Minister of Justice is responsible for assisting the Head of the Steering Committee in monitoring and urging ministries, ministerial-level agencies, government agencies and localities to implement the tasks stated in the Plan on schedule.
Ministries and ministerial-level agencies are responsible for the content of the review and proposal for promulgation of legal documents, ensuring full content, correct authority and time limit for promulgation of documents; proactively coordinate with the Ministry of Justice, the Ministry of Home Affairs, the Government Office and relevant agencies to promptly resolve within their authority or report to the Prime Minister and Deputy Prime Minister in charge of the field any issues arising beyond their authority.
The Ministry of Justice speeds up the appraisal process; the Government Office speeds up the processing of draft documents submitted by ministries and ministerial-level agencies to the Government and Prime Minister.
The plan also provides a list and assigns ministries and ministerial-level agencies to take the lead in drafting Government decrees on decentralization and assignment of authority in sectors and fields assigned for management related to the termination of operations of district-level local governments and the organization of two-level local governments.
In particular, the Ministry of Culture, Sports and Tourism is in charge of drafting the Decree amending and supplementing regulations on decentralization and division of authority in the fields of culture, family, physical education, sports, tourism; press, radio and television; news agencies; publishing, printing, distribution, electronic information, grassroots information and foreign information when organizing two-level local governments.
