On the morning of April 28, continuing the 44th session, the National Assembly Standing Committee gave opinions on the draft Law on Cadres and Civil Servants (amended), expected to be submitted to the National Assembly at the 9th session opening early next May.

In the submission, Minister of Home Affairs Pham Thi Thanh Tra said that the draft law removes regulations on commune-level officials and civil servants, to connect commune-level officials and civil servants with provincial-level officials, and unify a civil service regime from the central to commune level.
For current commune-level officials and civil servants, the draft law stipulates that they can be converted into officials and civil servants working at the new commune level if they meet enough standards and conditions.
In case of not meeting the standards and conditions to be assigned to a new commune-level job position, the regime and policies will be resolved according to Government regulations, according to Minister Pham Thi Thanh Tra.
The current Law on Cadres and Civil Servants devotes a whole chapter to specifically regulate 15 positions of commune-level cadres and civil servants. Accordingly, the 8 positions of commune-level cadres include: Party Committee Secretary, Deputy Secretary; Chairman, Vice Chairman of People's Council; Chairman, Vice Chairman of People's Committee; Chairman of Vietnam Fatherland Front Committee; Secretary of Ho Chi Minh Communist Youth Union; Chairman of Vietnam Women's Union; Chairman of Vietnam Farmers' Union; Chairman of Vietnam Veterans' Association.
7 commune-level civil servant positions, including: police chief; military commander; office - statistics; land - construction - urban and environment (for wards and towns) or land - agriculture - construction and environment (for communes); finance - accounting; justice - civil status; culture - society.
Current law also stipulates that commune-level civil servants are managed by district level.
Examining this issue, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung stated that the examining agency agreed to amend the regulations to connect communal-level officials and civil servants with provincial-level officials, unifying a civil service regime from the central to communal level.
The audit agency also found that the current interconnection is mature enough and is an urgent requirement to serve the arrangement and streamlining of the apparatus organization and implementation of the 2-level local government model.

Abolish regulations on civil servant promotion exams, allow experts to sign contracts to work as civil servants
Minister of Home Affairs Pham Thi Thanh Tra also said that the draft law also amends many regulations to change the method of recruiting and managing officials and civil servants according to job positions.
Accordingly, the draft law removes the regulation on exams for promotion, replacing it with a mechanism for appointment to a rank corresponding to the requirements of the assigned job position based on capacity and performance results.
The draft law also stipulates that the selected person must immediately meet the requirements of the job position, and after being selected, will be appointed, have a salary in the civil service category corresponding to the selected job position, and will not have to undergo a probationary period.
In addition, according to Ms. Tra, the draft law also assigns the Government to stipulate the framework of mechanisms and policies to attract, employ and treat talented people working in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations.
The civil servant management agency is allowed to sign a fixed-term contract with experts, scientists, and people who meet professional and technical requirements to perform certain tasks of the professional and technical civil servant job position.
During the review, Chairman of the Law and Justice Committee Hoang Thanh Tung agreed with most of the proposals, but suggested adding regulations on the authority to build and approve job positions.
The review agency also recommended carefully considering the impact of regulations on signing fixed-term contracts for experts, scientists, and people who meet professional and technical requirements to perform certain tasks of professional and technical civil servant positions when the mechanism of signing professional and technical contracts and the civil service and public service regime exist in parallel.
