Contribute comments on the draft Decree regulating land use fees and land rents

On the afternoon of May 20, Deputy Prime Minister Tran Hong Ha chaired an online conference with 63 provinces and centrally-run cities and central ministries, departments and branches to discuss the draft Decree regulating land use fees and land rents.

At Ninh Binh bridge, comrade Tran Song Tung, member of the Provincial Party Standing Committee, Vice Chairman of the Provincial People's Committee chaired the conference. Attending were leaders of a number of relevant departments, branches and localities in the province.

Speaking at the conference, Deputy Prime Minister Tran Hong Ha emphasized: The 2024 Land Law, passed by the 15th National Assembly at the 5th Extraordinary Session on January 18, 2024, has made major changes related to land finance and assigned the Government to detail a number of contents on land finance; including the contents on land use fees and land rent to replace the relevant Decrees guiding the 2013 Land Law that have been issued.

The Government has assigned the Ministry of Finance to draft a Decree regulating land use fees and land rents. Accordingly, the Draft Decree regulating land use fees and land rents consists of 5 chapters and 54 articles. Of which, Chapter I includes 2 articles regulating the scope of regulation and applicable subjects; Chapter II includes 20 articles regulating the calculation, collection and payment of land use fees; Chapter III includes 21 articles regulating the calculation, collection and payment of land rents; Chapter IV includes 6 articles regulating the responsibilities of agencies and land users; Chapter V includes 5 articles regulating the implementation provisions.

The draft has been consulted by 55 ministries, branches, corporations, and 58 localities, most of whom expressed their high agreement with the draft. However, there are still some contents with different opinions or difficulties in implementation. Therefore, before promulgation, the Government consults the ministries, branches, and localities for the last time to ensure unity, consensus, and feasibility in the implementation process and contribute to perfecting the policy to suit the new reality, reforming administrative procedures, ensuring effective mobilization of land use fees and land rents into the state budget; contributing to promoting effective land exploitation and use, contributing to socio-economic development.

Discussing at the conference, delegates said that the provisions in this draft Decree aim to be clearer and more specific than the current policy so that local authorities can facilitate implementation; without affecting the state budget revenue from land in particular and the state budget revenue in general.

In addition, delegates also requested clarification of some content that is still uncertain and problematic related to regulations on calculating land use fees when changing detailed planning; Principles for implementing exemption and reduction of land use fees; Unit price for land rent; Time for stabilizing land rent and paying annual rent (including cases of auctioning land use rights); Principles and procedures for exemption and reduction of land rent; cases of exemption of land rent; Transitional provisions for land use fees; land rent.

The comments at the conference will be received, synthesized, reviewed and finalized by the Government Office in coordination with the Ministry of Finance, the Ministry of Justice and the Ministry of Natural Resources and Environment to ensure that the draft is inherited from current regulations through practical implementation in accordance with the requirements of performing tasks; at the same time, any arising issues will be resolved, ensuring compliance with the provisions of the 2024 Land Law and relevant legal provisions.

Concluding the conference, Deputy Prime Minister Tran Hong Ha requested ministries and branches to coordinate with the Ministry of Finance to study and soon have a plan to supplement and complete the draft Decree on land use fees and land rents.
