Land valuation according to the principle of one price decided by the State

(NLDO) - Deputy Prime Minister Tran Hong Ha emphasized that land pricing must adhere to the principle of "one price" decided by the State.

According to the Ministry of Agriculture and Environment , after 1 year of implementing the 2024 Land Law, in addition to the achieved results, many shortcomings and problems have been revealed, requiring continued research, amendment and supplementation to suit reality and promote socio-economic development.

According to the assessment, the current planning and land use planning system is not suitable for the two-level local government organization model. Notably, regarding land prices, the State needs to control and decide on land prices in the primary market. However, currently, land valuation depends on secondary market land prices and consulting results from specialized units, leading to land prices not reflecting the true nature of reality.

Faced with the above difficulties and obstacles, the Ministry of Agriculture and Environment has drafted the Land Law (amended). During the drafting process, there were still different opinions on some contents such as: Removing the regulation that only the right to use residential land can be agreed upon to implement investment projects to build commercial housing; using the land price list as the basis for determining the financial obligations of land users, calculating compensation when the State reclaims land, and at the same time stipulating the coefficient for adjusting land prices and the rate for calculating land use fees according to each type of land.

Adjusting land prices according to market data and factors affecting land valuation

Concluding the meeting, the Deputy Prime Minister requested the Ministry of Agriculture and Environment to fully absorb all opinions, focusing on a number of key issues.

Regarding land access policy, the Deputy Prime Minister pointed out that the major problem is the lack of clear distinction between auction (selling land use rights to the highest bidder) and bidding (selecting investors to implement projects with optimal efficiency, low prices but meeting requirements).

"Auction is for specific benefits, bidding is for overall benefits" - The Deputy Prime Minister said and requested that the draft Land Law (amended) should stipulate clear criteria for each form of auction and bidding, with the view that economic growth is based on the efficiency of investment on land.

Regarding land finance policy, the Deputy Prime Minister affirmed that it is necessary to apply a unified land price list, adjusting prices according to market data while the land price coefficient remains unchanged if there is no new policy decision.

"Land pricing must adhere to the principle of "one price" decided by the State and applied consistently in all transactions. Land price adjustment for policy subjects should be assigned to localities to ensure fairness and achieve socio-economic efficiency," the Deputy Prime Minister requested.

The Ministry of Finance needs to be steadfast in its principle that real estate tax should be levied on abandoned land, behind-schedule projects, and empty houses, not on projects that use a lot of land for development.

Regarding the backlog of land and real estate projects, the Deputy Prime Minister requested that the draft Law must have legal tools to resolve them once and for all, avoiding waste. In addition, when expanding the State's right to decide on land, it is necessary to ensure the rights of the people.

The Deputy Prime Minister suggested carefully studying regulations to "selectively open up", allowing scientists, businessmen, and patriotic foreigners to access real estate outside restricted areas, while still ensuring national defense and security requirements.
