Promote decentralization and delegation of power, in sync with the 2-level local government model.

The document states: Implementing the policy of promoting decentralization and delegation according to the direction of the Politburo in Official Dispatch No. 13078-CV/VPTW dated January 14, 2025 of the Office of the Central Executive Committee, institutionalized in Clause 2, Article 32 of the Law on Organization of the Government 2025, Clause 1, Article 50 of the Law on Organization of Local Government 2025, the Prime Minister issued Decision No. 608/QD-TTg dated March 15, 2025 on the plan to implement tasks and solutions to promote decentralization and delegation according to the provisions of the Law on Organization of the Government and the Law on Organization of Local Government; At the same time, based on Plan No. 47-KH/BCĐ dated April 14, 2025 of the Central Steering Committee on summarizing Resolution No. 18-NQ/TW on the implementation of the arrangement and merger of provincial and communal administrative units and the organization of the 2-level local government system, the Prime Minister issued Decision No. 758/QD-TTg and Decision No. 759/QD-TTg dated April 14, 2025, which identified the tasks, solutions and assigned specific responsibilities to ministries, branches and localities for implementation. In order to focus on effectively implementing the tasks in the above Plans, especially in priority and urgent areas, the Prime Minister, Head of the Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW of the Government, requested the heads of ministries, branches and localities to urgently implement the following contents:

1- Clearly identify priority and urgent issues of sectors and fields under management; review the entire system of related specialized legal documents; develop and submit to the Government for promulgation of legal documents within its authority to promptly adjust the authority of the Government, Prime Minister, Ministers, and local authorities according to the requirements of promoting decentralization and delegation of power, in sync with the implementation of the 2-level local government model, creating a legal corridor, promptly handling practical issues, removing institutional "bottlenecks", contributing to the implementation of socio-economic development goals according to Resolution No. 192/2025/QH15 dated February 19, 2025 of the National Assembly. Completion date before June 30, 2025.

2- Closely follow the content of the task requirements in Decision No. 608/QD-TTg dated March 15, 2025, Decision No. 758/QD-TTg dated April 14, 2025, Decision No. 759/QD-TTg dated April 14, 2025, issue according to authority or submit to competent authorities to issue regulations and instructions to promote decentralization and delegation of power associated with the task of implementing the construction of a 2-level local government organization model, ensuring progress and quality as required.

3- Some general requirements when drafting legal documents

a) Thoroughly grasp the spirit of innovation in law-making thinking according to the requirements of the General Secretary and the viewpoint of promoting decentralization and delegation to create initiative for localities in the spirit of: "locality decides, locality does, locality takes responsibility" associated with the implementation of the 2-level local government model.

b) For issues identified as falling under the authority of the National Assembly, it is necessary to clarify the basis for proposals to ensure that these issues are fundamental and important national issues, in accordance with the spirit of the Constitution.

c) Based on the principle of delimitation of authority in the Law on Organization of the Government and the Law on Organization of Local Government in 2025, it is required that: (1) The names of ministries, branches and specific tasks and powers of ministries and branches are not specified in the Law (no direct delegation of authority to Ministers in the Law ensures the Government's unified state management of sectors and fields, and assigns the scope of state management to ministries and ministerial-level agencies; (2) Clearly define the responsibilities of Ministers and Heads of ministerial-level agencies for sectors and fields assigned to them for management, avoiding pushing responsibility onto the Prime Minister (the Prime Minister leads the work of the Government, does not decide on specific issues under the responsibility of Ministers and Heads of ministerial-level agencies as members of the Government for sectors and fields assigned to them for management).

Implementation results are sent to the Ministry of Home Affairs (Standing Agency of the Steering Committee) periodically before the 20th of each month for monitoring, synthesis, and reporting to competent authorities as prescribed.
