At Point C, Clause 2, Article 33 of Circular 32/2023/TT-BCA, effective from September 15, 2023, it is stipulated that the Commune Police will be allowed to handle some violations when there is no traffic police force accompanying them.
Accordingly, in case there is no traffic police force accompanying, the commune police can still conduct patrols and controls according to the approved plan, then must report the situation, results of patrols, controls, and handling of violations to the traffic police force.
However, the commune police are only allowed to patrol, control, and handle violations on commune roads and other roads under the commune's management.
Also according to Circular 32 of the Ministry of Public Security, the Commune Police are allowed to stop motorbikes, electric motorbikes, and rudimentary vehicles to handle violations including: Not wearing helmets as prescribed; Carrying more people; Carrying bulky goods, exceeding the size limit; Stopping or parking in violation of regulations; Speeding, weaving, swerving; No rearview mirror on the left side; Using umbrellas; Not being old enough to drive.

In addition, if a vehicle is found to be seriously violating traffic order, safety, security, and social order and is not stopped promptly, causing dangerous consequences for society, it will also be handled according to regulations.
During the process of handling violations, if other violations are discovered, they will be handled according to authority. If they exceed authority, the commune police will make a record and report to the competent authority to issue a decision on punishment.
Thus, when accompanied by traffic police, the commune police are allowed to stop to check and handle motorcyclists, motorbikes, electric motorbikes, and rudimentary vehicles when there are signs of violating the above-mentioned errors.
The command to stop vehicles, conduct inspections and handle violations shall comply with the provisions of Clause 2, Article 12, Article 17, Article 18, Article 20, Article 21, Article 22, Article 24, Article 25, Article 26, Article 27 of Circular 32/2023/TT-BCA.
