Recently, the Office of the President held a press conference to announce the President's order to promulgate 7 laws passed by the National Assembly at the 6th session, including the Housing Law (amended) with 13 chapters and 198 articles, effective January 1, 2025.

Informing about the new points of the Housing Law, Deputy Minister of Construction Nguyen Van Sinh said that compared to the current law, the new law amends and supplements a number of regulations on the development of commercial housing, public housing, resettlement housing, and individual housing to create favorable conditions for organizations, businesses, and individuals to participate in housing development.

As for multi-storey houses with many apartments of individuals (mini apartments) for sale, lease-purchase, or rent, the law supplements regulations in a stricter direction on investment and construction conditions, in order to ensure the safety of people's status and property.

Responding to the press on this issue, Deputy Minister Nguyen Van Sinh said that the Housing Law 2023 clearly stipulates the conditions for developing multi-storey houses and multi-apartment houses of individuals for sale or rent. Individuals with land use rights who want to build multi-storey houses and multi-apartment houses for sale, lease-purchase or rent must meet the conditions for being investors in housing projects.

Notably, according to the law, mini apartments (houses with 2 floors or more, each floor has an apartment design, or 2 floors with a scale of 20 apartments or more) that meet the conditions will be granted a certificate (also known as a pink book) according to the land law; can be sold, rented, or leased according to the provisions of the Housing Law and the law on real estate business.

According to Mr. Sinh, individuals with land use rights who want to build mini apartments (houses with 2 floors or more and a scale of less than 20 apartments, each floor has a design) for rent only must meet 3 conditions.

Firstly, it is to meet the requirements for housing construction according to the regulations of the Minister of Construction and there will be specific regulations in the future.

Second, it is to meet the requirements of fire prevention and fighting. The third condition is to meet the traffic requirements for fire fighting vehicles to perform fire fighting tasks at multi-storey residential buildings with many individual apartments according to the regulations of the Provincial People's Committee.

The Deputy Minister of Construction also said that the Housing Law supplements many regulations on social housing development. In particular, the law clearly defines the responsibility for allocating land for social housing development as the responsibility of local authorities. Specifically, in the process of formulating and approving construction and urban planning, the provincial People's Committee must allocate sufficient land for social housing development according to the approved housing development program and plan.

"The delegation of authority is linked with responsibility to create a flexible mechanism for local implementation," according to Mr. Sinh.

More than 5,000 hectares of land will be reclaimed to implement the project in 2024.

The Chairman of the People's Committee of Quang Nam province has just approved the list of land acquisition projects in 2024 in the province, which was approved by the 10th Provincial People's Council, 18th Session.

Accordingly, the land recovery project in 2024 includes 1,377 categories with a total recovered land area of ​​5,492.87 hectares, of which the agricultural land area is 847.40 hectares, including 575.95 hectares of specialized rice land, 128.08 hectares of remaining rice land, and 143.37 hectares of protective forest land.

The Provincial People's Committee assigns the Department of Natural Resources and Environment to preside over and guide localities based on the list and area of ​​land recovery projects in 2024 approved by the Provincial People's Council in Resolution No. 53/NQ-HDND dated December 8, 2023 and approved by the Provincial People's Committee in Article 1 of this Decision to complete the land use plan dossier for 2024, send it to the Provincial Council for Appraisal of Planning and Land Use Plans at the district level for appraisal, and submit it to the Provincial People's Committee for approval to implement in accordance with regulations. Coordinate with relevant departments, branches, localities and units to closely inspect and monitor land recovery in accordance with regulations.

The lists of land recovery and land use conversion related to natural forests are implemented in accordance with Conclusion No. 61-KL/TW dated August 17, 2023, Directive No. 13/CT-TW dated January 12, 2017 of the Central Party Secretariat and Resolution No. 71/NQ-CP dated August 8, 2017 of the Government and relevant legal regulations.

Project lists related to rice-growing land must be strictly controlled according to the Government's policy. In case the project uses 10 hectares of rice-growing land or more, 20 hectares of protective forest land or special-use forest land or more, the procedure must be established to advise the Provincial People's Committee to report to the Prime Minister for consideration and decision on changing the purpose of using rice-growing land and forest land in accordance with the prescribed order and procedures. Strengthen responsibility in the appraisal of annual land-use plans and land recovery lists, advise the Provincial People's Committee to submit to the Provincial People's Council to ensure information and time as prescribed.

Accordingly, Da Nang reduced 10% of the land price issued in the land price list for commercial and service land, reducing from 70% to 60% of the land price in the land price list. For land plots with a depth of more than 100m, Da Nang re-determines the land price adjustment coefficient to calculate land use fees in accordance with reality.

This Decision comes into force from January 1, 2024.

Specifically, according to the land price list, the highest price of commercial and urban service land in Da Nang is 59.2 million VND/m2, mainly concentrated in Hai Chau district.
