On the afternoon of June 28, with 463/464 National Assembly Deputies present in favor, the National Assembly passed the Law amending and supplementing a number of articles of the Law on Security Guards.

The law adds that the person holding the position of Standing Secretary of the Secretariat, Chief Justice of the Supreme People's Court and Chief Prosecutor of the Supreme People's Procuracy will be assigned guards.

The Standing Secretariat will be protected when approaching, staying and working. In addition, traffic police vehicles will be arranged to guide the way when traveling domestically by car if necessary.

The Chief Justice of the Supreme People's Court and the Chief Prosecutor of the Supreme People's Procuracy are protected and are provided with a traffic police car to guide them when traveling domestically by car if necessary.

Before the Law amending and supplementing a number of articles of the Law on Guards was passed, presenting a report explaining, accepting and revising the draft law, Chairman of the National Defense and Security Committee Le Tan Toi said that some opinions suggested considering adding the guard subject to the Standing Committee of the Secretariat, because there was already a guard subject who was a member of the Politburo.

There are opinions that "according to the working regulations of the Secretariat, the Standing Secretariat includes the General Secretary and the Standing Secretariat"; there are opinions suggesting adding a separate protection regime and measures for the Standing Secretariat.

Explaining, the National Assembly Standing Committee said that Clause 1, Article 10 of the Law on Guards stipulates that the subjects of guarding are those holding key leadership positions and titles, senior leaders of the Party, State, and Central Committee of the Vietnam Fatherland Front. The direction of listing specific subjects of guarding is consistent with the content of Conclusion No. 35 of the Politburo.

According to Conclusion 35, senior leaders of the Party, State and Vietnam Fatherland Front include: Standing member of the Secretariat, Politburo member, Secretariat member...

The current Law on Security Guards stipulates that people holding positions and titles of Politburo members and Central Party Secretaries (Secretariat members) are subjects of security guarding, and a person who enjoys many different security regimes is entitled to the highest level of security regime. Therefore, the amended law adding that people holding positions and titles of Standing Secretariat members are subjects of security guarding is appropriate and does not contradict the provisions of the Secretariat's Working Regulations.

The Minister of Public Security decided to apply security measures when necessary.

According to the amended Law on Guards, in cases where it is necessary to protect national security, ensure social order and safety, and ensure foreign affairs, the Minister of Public Security shall decide to apply appropriate guard measures to subjects not covered by the provisions of the Law on Guards.

In addition to agreement, some opinions suggested clarifying the criteria, urgent cases, and assessing the compatibility of the authority of the Minister of Public Security with the provisions of the Constitution.

The National Assembly Standing Committee said that from July 2018 to present, the Minister of Public Security has decided to apply security measures to 56 cases that are not subject to security to meet the requirements of protecting national security, ensuring social order and safety or at the request of ministries, branches, and foreign diplomatic missions in Vietnam.

The work of protecting national security and ensuring social order and safety always contains unexpected and unpredictable elements, requiring the law to have flexible regulations to facilitate implementation.

In addition to ensuring security and safety for VIPs, the security force also actively serves foreign affairs and Vietnam's image with international friends.

To ensure strictness, the Law has clearly limited the urgent cases in which the Minister of Public Security can decide to apply security measures, which are to protect national security, ensure social order and safety, and ensure foreign affairs.
