New policies for civil servants and public employees effective from September 2023 include:

1. Amending the criteria for classifying the quality of cadres, civil servants and public employees at the level of not completing their tasks

On July 17, 2023, the Government issued Decree 48/2023/ND-CP amending Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees.

Accordingly, Clause 4, Article 1 of Decree 48/2023/ND-CP stipulates the removal of the phrase "in the process of performing tasks" in Clause 5, Article 7; Point c, Clause 1 and Point d, Clause 2, Article 11; Point c, Clause 1 and Point d, Clause 2, Article 15 of Decree 90/2020/ND-CP.

Thus, one of the criteria for classifying the quality of cadres, civil servants and public employees at the level of not completing their tasks is as follows:

There was a violation that was disciplined during the assessment year.

Decree 48/2023/ND-CP takes effect from September 15, 2023.

2. Supplementing guidance on evaluating cadres and civil servants disciplined by the Party

Decree 48/2023/ND-CP has added guidance on evaluating cadres and civil servants subject to Party discipline as follows:

Cadres, civil servants and public employees subject to party or administrative discipline shall have their quality assessed and classified as follows:

- Cadres, civil servants and public employees who are subject to party or administrative disciplinary action in the year of assessment shall be classified as having failed to complete their tasks, except for the case specified in Point b of this Clause.

- In case the violation has not been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.

- In case a cadre, civil servant or public employee is a party member and has been subject to party discipline and administrative discipline for the same violation but the party discipline decision and administrative discipline decision are not effective in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.

Decree 48/2023/ND-CP takes effect from September 15, 2023.

3. Instructions for adjusting monthly allowance levels for retired elderly commune officials

This is the content of Circular 11/2023/TT-BNV guiding the adjustment of monthly allowance levels for retired elderly commune, ward and town officials, effective from September 15, 2023.

From July 1, 2023, the monthly allowance level for retired elderly commune officials will be adjusted according to the provisions of Article 2 of Decree 42/2023/ND-CP as follows:

(i) Increase the monthly allowance by 12.5% ​​above the allowance received in June 2023 for the subjects specified in Article 1 of Circular 11/2023/TT-BNV.

The monthly allowance received from July 1, 2023 is calculated according to the following formula:

In which: The subsidy level received at the time of June 2023 is the subsidy level prescribed in Clause 3, Article 2 of Circular 02/2022/TT-BNV guiding the adjustment of monthly subsidy levels from January 1, 2022 for commune, ward and town officials who have retired according to Decision 130-CP dated June 20, 1975 and Decision 111-HDBT dated October 13, 1981.

(ii) From July 1, 2023, after adjusting the monthly allowance for retired elderly commune officials according to the provisions in (i), if the allowance received is lower than VND 3,000,000/month, it will be adjusted to increase as follows:

- Increase by 300,000 VND/person/month for those whose monthly allowance is less than 2,700,000 VND/person/month;

- Increase by 3,000,000 VND/person/month for those with monthly allowance from 2,700,000 VND/person/month to less than 3,000,000 VND/person/month.

(iii) Pursuant to the provisions in (i) and (ii), retired elderly commune cadres will receive a monthly allowance from July 1, 2023 (rounded) as follows:

- For former Party Committee Secretaries, People's Committee Chairmen, Deputy Secretaries, Vice Chairmen, Standing Party Committee Members, People's Committee Secretaries, Commune People's Council Secretaries, Commune Team Leaders, Commune Police Chiefs: VND 3,000,000/month;

- For remaining positions: VND 2,817,000/month.

4. Guidance on job positions for civil servants and public employees in various fields

Specifically, instructions on job positions for civil servants and public employees in various fields are stipulated in the following documents:

- Circular 16/2023/TT-BKHCN providing guidance on job positions of civil servants specializing in science and technology in agencies and organizations in the science and technology sector and field, issued by the Minister of Science and Technology, effective from September 25, 2023.

- Circular 05/2023/TT-BTNMT providing guidance on professional civil servant positions in the field of natural resources and environment issued by the Minister of Natural Resources and Environment, effective from September 18, 2023.

- Circular 09/2023/TT-BTTTT guiding the job positions of professional civil servants in the field of Information and Communications in agencies and organizations in the field of Information and Communications issued by the Minister of Information and Communications, effective from September 15, 2023.

- Circular 08/2023/TT-BTTTT providing guidance on leadership and management positions and professional titles of specialized civil servants, and the structure of civil servants according to professional titles in public service units in the Information and Communications sector and field, issued by the Minister of Information and Communications, effective from September 15, 2023.

- Circular 01/2023/TT-UBDT providing guidance on job positions of civil servants specializing in ethnic affairs in agencies and organizations in the ethnic affairs sector and field issued by the Minister and Chairman of the Ethnic Affairs Committee, effective from September 15, 2023.
