The Minister of Health issued Circular No. 27/2024/TT-BYT amending and supplementing a number of articles of Circular No. 20/2017/TT-BYT dated May 10, 2017 of the Minister of Health detailing a number of articles of the Law on Pharmacy and Decree No. 54/2017/ND-CP dated May 8, 2017 of the Government on drugs and pharmaceutical ingredients subject to special control.
Circular 27 amends and supplements Point d, Clause 1, Article 1 of Circular 20 as follows: The list of drugs and pharmaceutical substances on the list of substances prohibited from use in a number of sectors and fields is announced according to the Decision of the Minister of Health.
Circular 27 also clearly states that private medical examination and treatment facilities, research and testing facilities, medical and pharmaceutical training facilities, compulsory drug rehabilitation facilities, facilities for treating opioid addiction with replacement drugs, and other non-commercial pharmaceutical activities must prepare a dossier requesting the purchase of drugs according to the provisions of Article 53 of Decree No. 54/2017/ND-CP, Clause 23, Article 4 and Clause 33, Article 5 of Decree No. 155/2018/ND-CP and send it to the Department of Health where the facility is headquartered or the Department of Military Medicine of the Ministry of National Defense for consideration and approval according to the provisions of Article 54 of Decree No. 54/2017/ND-CP and Clause 34, Article 5 of Decree No. 155/2018/ND-CP before purchasing addictive drugs, psychotropic drugs and precursor drugs.
This Circular takes effect from January 30, 2025. Applications submitted before the effective date of this Circular shall continue to be implemented in accordance with the regulations at the time of application submission; except in cases where the facility requests implementation in accordance with the provisions of this Circular.
Licenses for exporting and importing drugs and pharmaceutical ingredients, and orders for exporting and importing drugs and pharmaceutical ingredients issued before the effective date of this Circular shall continue to be used until the expiration of the license.
Drugs and pharmaceutical ingredients that have been granted a certificate of registration for circulation in Vietnam, and pharmaceutical ingredients that have been declared for drug production according to the drug registration dossier that has been granted a certificate of registration for circulation in Vietnam and are exported from the port of departure of the exporting country before the effective date of this Circular, the import shall be subject to the List of drugs and pharmaceutical ingredients on the list of substances prohibited from use in a number of industries and fields in the guiding document in effect at the time the goods are exported from the port of departure of the exporting country.
Regarding Circular 27, the Ministry of Health has just issued a decision on the announcement of the list of drugs and pharmaceutical substances on the list of substances prohibited from use in a number of sectors and fields specified in Clause 1, Article 1. This decision takes effect from January 30, 2025.
