According to the guidelines, if the reorganization results in more leaders at a certain level than the prescribed number, these managers will be considered for early retirement. This applies even if they have previously decided or announced their retirement.

Contract employees working under labor contracts at reorganized agencies and units, and their contracts were signed before January 15, 2019 and then renewed, are also eligible for this policy. District-level officials whose official retirement date is early will be calculated from the time the district completes the reorganization.

If the rearrangement of district and commune-level administrative units in the 2019-2021 and 2023-2025 periods causes officials and civil servants to quit their jobs after January 1, 2025, they will enjoy policies according to relevant decrees.

Employees in the field of drug rehabilitation, those who work in drug rehabilitation facilities managed by the Ministry of Labor - Invalids and Social Affairs, who are now transferred to the police force but are not accepted by the police, are not assigned other jobs and wish to retire, will be granted early retirement benefits by the province.

People working at associations assigned by the Party and State at the central, provincial and district levels to carry out mergers, who are of working age and have a decision from a competent authority to mobilize them to work at the association, and people recruited within the association's staffing quota, are also eligible for the policy.

The Ministry of Home Affairs also outlined cases that are not eligible for early retirement, including managers who are not directly reassigned. If their agencies or units are not directly reassigned, even if the number of deputies may be less than the regulations, they are still not eligible for early retirement.

Employees who have terminated their old contracts and signed new contracts after January 15, 2019, even if their old contracts were signed before that time, re-signing the contract after this time will make them ineligible for the policy.

Employees who meet the requirements of seniority in heavy, toxic, dangerous work or work in particularly difficult areas, reach retirement age and have paid social insurance for 20 years, will retire according to the Law on Social Insurance and are not eligible for early retirement policy due to streamlining the apparatus.

According to the guidance of the Ministry of Home Affairs, allowances for job responsibility, toxicity, danger, area, attraction, responsibility of the Party Committee, chief accountant... are not included in the current monthly salary to calculate the early retirement regime. Reserved leadership position allowances are included. The current monthly salary when taking unpaid leave or sick leave is the month immediately preceding the leave. The basic salary is calculated based on the salary immediately preceding the leave.

Decree 178 was issued by the Government at the end of December 2024, stipulating policies for cadres, civil servants, public employees, workers and armed forces when restructuring the apparatus. Accordingly, people who are up to 10 years old (normal conditions) or 5 years old (particularly difficult areas) from the maximum retirement age and have paid compulsory social insurance for a sufficient period of time will enjoy three support regimes.

Officials and civil servants who have more than 2 years left until retirement age and do not meet the conditions for early retirement, if they quit their jobs, will enjoy four regimes. Officials and employees who quit their jobs will also enjoy four similar regimes, but the fourth regime is unemployment benefits.

In mid-March, the Government issued Decree 67 amending Decree 178, adding four groups to enjoy early retirement policies when streamlining the apparatus of the political system.
