Regarding the second phase of the "rescue flight", defendant Nguyen Xuan Thong (born in 1975, former police officer) was proposed to be prosecuted for the crime of Concealing a criminal.

According to the investigation conclusion, in June 2021, Mr. Thong was discussed with Mr. Tran Minh Tuan (Director of Thai Hoa Company - phase 1 of the case) about Mr. Tuan organizing a flight to bring Vietnamese workers abroad back to the country to avoid the Covid-19 epidemic.

Mr. Tuan said that he had relationships and received help from 4 Ministries in the 5-Ministry Working Group. As for the Ministry of Public Security, Mr. Tuan asked Mr. Thong to connect and influence the Immigration Department (QLXNC) to inspect and soon issue a document agreeing to allow Quang Trung Construction and Human Resources Management Company to organize and carry out the flight.

After receiving written approval from the Immigration Department (Ministry of Public Security), Quang Trung Construction and Human Resources Company organized to bring workers from Taiwan to Hai Duong province for quarantine on June 30, 2021.

In addition, Mr. Tuan also asked Mr. Thong to intervene and influence the Department of Immigration to resolve the procedures for applying for a flight license for Hanoi Sky Travel and Events Company Limited (Hanoi Sky Company) and International Travel Company Limited (International Travel Company). At that time, Mr. Thong agreed to help and contacted the Department of Immigration many times but could not resolve the issue.

In June 2022, when he was investigated for bribery to individuals to carry out and organize flights, Mr. Tuan contacted and discussed with Mr. Thong to seek help.

According to the Investigation Police, when Mr. Tuan was summoned to work by the Investigation Police (on July 20, 2022) and knew that Mr. Tuan was being investigated for bribery to individuals to get approval to carry out and organize the flight, Mr. Thong intervened and asked the investigator to allow Mr. Tuan to postpone the working time.

On July 28, 2022, Mr. Thong and Tuan and some other people met at a restaurant near the headquarters of the Ministry of Public Security so that Mr. Thong could advise and guide Mr. Tuan and others to report to the Investigation Police about the contents related to the case in a direction favorable to Mr. Tuan.

At that meeting, Mr. Tuan said he received more than 10 billion VND from Ms. Pham Bich Hang (Deputy Director of International Travel Company Limited - phase 1 of the case) to bribe authorized individuals and cover expenses in applying for procedures to organize flights for some of Ms. Hang's businesses.

Mr. Tuan asked Mr. Thong to guide him on how to declare to the Investigation Agency to gain benefits. At that time, Mr. Thong and other individuals discussed and agreed to instruct Mr. Tuan and others not to declare to the Investigation Agency about the amount of money that Mr. Tuan received from Ms. Hang to give bribes, but to declare (falsely) that Mr. Tuan had returned all of this money to Ms. Hang... As for other contents, just declare that you do not know and think about it and answer later.

Afterwards, when working with the Investigation Police, Mr. Tuan confessed as instructed. And to avoid being investigated and prosecuted, from October 26, 2022, Mr. Tuan fled his residence, causing the Investigation Police to be unable to execute the decision to prosecute the accused and the Order to arrest the accused for temporary detention against him.

It was only when the Security Investigation Agency coordinated with other units and functional forces of the Ministry of Public Security that Mr. Tuan was discovered and arrested on November 25, 2022, when he was in hiding in Thua Thien - Hue.

During the period of detention for investigation, the director of Thai Hoa Company continued to make false statements as instructed to conceal his criminal acts, causing great difficulties and obstacles to the investigation. The investigation conclusion indicated that Mr. Nguyen Xuan Thong knew that Mr. Tran Minh Tuan had committed bribery but still instructed the business owner to make false statements to conceal his criminal acts, hindering the investigation.
