Ho Chi Minh City People's Committee officially proposed to remove the additional support policy for officials and civil servants who quit their jobs.

(NLDO) - Cases of officials and civil servants who received additional support policies under Resolution 01 before March 15 will not be affected.


The Ho Chi Minh City People's Committee has just submitted a document to the Standing Committee of the Ho Chi Minh City People's Council proposing to draft a Resolution to abolish Resolution 01/2025.

Resolution 01 contains content on additional support regime for cadres, civil servants, public employees, and workers when implementing organizational arrangement, restructuring and rearranging administrative units at all levels of the political system; cases in charge of party work at corporations and companies in which the State holds 100% of charter capital are affected when implementing party organization arrangement; cases ineligible for age re-election, re-appointment to hold positions and titles according to term in the locality.

Explaining the above proposal, the Ho Chi Minh City People's Committee said that Resolution 01 was built on the basis of Clause 6, Article 19 of Decree 178/2024: "Based on the ability to balance the local budget, submit to the People's Council of the same level to issue additional support policies for subjects under management".

However, on March 15, 2025, the Government issued Decree 67/2025. Accordingly, the provision in Clause 17, Article 1 of Decree 67 has removed Clause 6, Article 19 of Decree 178.

Thus, the legal basis for building Resolution 01 according to detailed articles and clauses has been abolished. The additional support policies for cadres, civil servants, public employees and workers when implementing organizational restructuring, restructuring and rearranging administrative units at all levels of the political system must stop being implemented because the legal provisions have expired.

In addition, based on Clause 1, Article 1 of Decree 67 amending and supplementing Article 1 of Decree 178, the groups of agencies, units and subjects specified in Resolution 01 have basically been specified in Decree 67 mentioned above.

Therefore, there is no longer a basis for developing a Resolution as prescribed in Clause 4, Article 27 of the Law on Promulgation of Legal Documents 2015 (amended and supplemented in 2020).

Therefore, based on the provisions of Point a, Clause 1, Article 143 of Decree 34/2016, the abolition of Resolution 01 is in accordance with regulations and must be implemented immediately. At the same time, there are transitional provisions to ensure the rights of cases that have been resolved by competent authorities with additional support policies before March 15, 2025.

Cases that have been resolved by competent authorities for additional support policies under Resolution 01 before March 15, 2025 will still enjoy additional support policies under Resolution 01.

Resolution 01/2025 was passed by the Ho Chi Minh City People's Council on February 20, 2025 at the 21st session (special session). This resolution allows additional support for officials and civil servants who quit their jobs or retire early due to organizational restructuring, with the highest level of up to 1.1 billion VND/person.

If the early retirement regime in Article 7 of Decree 178/2024 is calculated as 1.575 billion VND/person, then when officials and civil servants quit their jobs, they can receive support of nearly 2.7 billion VND/person. Ho Chi Minh City plans to spend nearly 17,000 billion VND to support officials and civil servants.
