At the morning discussion session on February 13, discussing the Draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the State apparatus, National Assembly deputies expressed their agreement with the necessity of issuing the resolution; at the same time, highly appreciated the Government's initiative in drafting and submitting this Resolution to the National Assembly for promulgation.
Delegates said that the resolution will create a legal basis for the reorganization of the State apparatus at the central and local levels. Thereby, issues arising in the reorganization of the State apparatus will be promptly handled, avoiding legal gaps; ensuring the normal, continuous and smooth operation of the State apparatus and the whole society; ensuring human rights and civil rights in accordance with the law.
Speaking at the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai affirmed that streamlining and reorganizing the apparatus will create conditions for concentrating investment resources to carry out urgent tasks and long-term goals; including urgent tasks being implemented right in this 9th Extraordinary Session.
Streamlining the new apparatus can focus resources on implementing development investment, reducing regular expenditures, increasing investment expenditures but not reducing regular expenditure items equally.
Vice Chairman of the National Assembly Nguyen Duc Hai noted that in the short term, the administrative apparatus should be reorganized, but in the long term, it is necessary to implement a roadmap to amend the State Budget Law and laws on tax management, because the activities of all levels of government are related to the budget.
Participating in the discussion in the group, delegate To Van Tam (National Assembly Delegation of Kon Tum province) said that in the process of restructuring the apparatus, there will be problems that the Draft Resolution has not covered or fully anticipated, so it is necessary to have regulations to handle these problems.
Emphasizing the urgency of the issues arising, delegate To Van Tam said that the authorization as in the Draft Resolution is necessary, however, if issued according to the procedures of the Law on Promulgation of Legal Documents, it will still be slow. Therefore, it is necessary to apply a simplified procedure for the issuance of these regulations.
Regarding the content stipulated in Clause 6, Article 4 of the Draft Resolution: the supervision, inspection, audit and examination of agencies established or receiving functions, tasks and powers after the reorganization of the State apparatus must be carried out in accordance with the provisions of law and must ensure continuity, no vacancy or overlap in the scope of authority for supervision, inspection, audit and examination and must not affect the normal operation of the agencies subject to supervision, inspection, audit and examination.
Delegate To Van Tam raised the issue that such a regulation may not be comprehensive, because after the reorganization, some agencies will cease operations, transfer tasks, and re-enter another agency. Specifically, currently there are no more district-level police, the district-level police force has been transferred to the commune level, so how will the trial and prosecution of cases at the district level be? The delegate suggested reviewing and clarifying this regulation to ensure feasibility and smoothness in the implementation process.
Delegate Pham Dinh Thanh (National Assembly Delegation of Kon Tum Province) expressed that, according to the Draft, the Resolution has an implementation period until February 28, 2027. From now until that time, State agencies must issue a complete system of legal documents to serve the arrangement and organization of the State apparatus.
However, according to information from the Ministry of Justice, there are over 150 laws and over 200 decrees that need to be amended and issued. The urgent time puts great pressure on the Government and the Central Government. Therefore, delegates proposed to extend the implementation period of the Resolution to 3 years, or until 2029 to ensure the effective issuance of the legal document system.
In addition, the Draft Resolution needs to take effect immediately to ensure continuous and smooth operation of the State apparatus and the whole society; not interrupt the implementation of international treaties and agreements, and not affect the people.
