The Government has just issued Decree No. 48/2024/ND-CP amending and supplementing a number of articles of Decree No. 130/2018/ND-CP dated September 27, 2018 of the Government detailing the implementation of the Law on Electronic Transactions on digital signatures and digital signature certification services.

Decree 48/2024/ND-CP amends and supplements Article 23. Dossier for issuing digital certificates of subscribers:

1- Application for a digital certificate in paper or electronic form according to the form of the organization providing public digital signature certification services.

2- Attached documents and files include:

For individuals: Citizen identification card or identity card or identity certificate or passport or use level 2 electronic identification account.

For organizations: Decision on establishment or decision on regulations on functions, tasks, powers, organizational structure or business registration certificate or investment certificate and citizen identification card or identity card or identity certificate or passport of the legal representative of the organization; or use of the organization's electronic identification account.

3- Individuals and organizations have the right to choose to submit a copy from the original book, a certified copy, or submit a copy with the original for comparison or provide electronic data for use and exploitation by organizations providing public digital signature certification services according to the provisions of Clause 4.

4- In case an individual or legal representative of an organization provides or uses information in the citizen identification card or identification card or identification certificate or information in the individual's level 2 electronic identification account or information in the organization's identification account, the organization providing public digital signature certification services (which has a written approval to connect to the electronic identification and authentication system according to the law on electronic identification and authentication or has sufficient means to read data in the electronic chip, data in the level 2 electronic identification account) exploits data in the electronic chip, data of the individual's level 2 electronic identification account, the organization's electronic identification account, without requiring the individual or legal representative of the organization to submit the records and documents as prescribed in Clause 3 above.

5- The organization providing public digital signature certification services is responsible for providing utilities or applications to implement the electronic reception method.

Amending the conditions for granting licenses to use foreign digital certificates in Vietnam

Regarding foreign digital certificates and digital signatures in Vietnam, the Decree amends and supplements Point b, Clause 1, Article 46 on conditions for granting licenses to use as follows:

For subscribers using foreign digital certificates in Vietnam, they must have one of the following documents or an electronic identification account to authenticate the information on the digital certificate:

- Business registration certificate, investment certificate, establishment decision, decision defining functions, tasks, and powers of the organization; identity card, citizen identification card, passport for individuals;

- Level 2 electronic identification account for individuals; electronic identification account of an organization for organizations;

- Document from a competent authority allowing foreign organizations and individuals to legally operate in Vietnam for subscribers who are foreign organizations and individuals;

- In case of authorization to use digital certificates, there must be legal authorization to use digital certificates and the subscriber information granted digital certificates must be consistent with the information in the authorization document./.
