Latest regulations on land subdivision and subdivision area in Nam Dinh

The People's Committee of Nam Dinh province has just issued Decision No. 35/2024 regulating the conditions and minimum area for land division and consolidation in the locality. This regulation will take effect from October 1.

Regarding the demarcation of areas to regulate the minimum area allowed for land division in the province, area I includes land locations in wards of Nam Dinh city and existing towns.

Area II includes land plots in residential areas located along national highways, provincial roads, and district roads; residential areas located along commune roads. In addition, there are land plots in residential areas in specific areas in Nam Dinh City, Truc Ninh District, Y Yen District, Xuan Truong District, Giao Thuy District, and Hai Hau District.

Area III includes land locations in the remaining areas.

In area I, with a land plot being a component part of a street or alley with a road width of over 2.5m, the residential land plot after being divided must have a minimum area of ​​30m2, a minimum frontage width of 4m, and a minimum depth compared to the construction boundary of 5m.

If the alley has a road width of less than or equal to 2.5m, it must have a minimum area of ​​45m2, a minimum frontage width of 4m, and a minimum depth compared to the construction boundary of 7m.

In areas II and III, the residential land plots after subdivision have a minimum area of ​​50m2 and 80m2 respectively, with a minimum frontage width of 4m and a minimum depth of 7m from the construction boundary.

For commercial and service land, after subdivision, the minimum area is 1,000m2, the minimum frontage width is 15m, and the minimum depth from the construction boundary is 20m.

For non- agricultural production land, the minimum area is 3,000m2, the minimum frontage width is 20m, and the minimum depth from the construction boundary is 25m.

Regarding transitional regulations, for land plots in use or divided land plots with residential land area smaller than the minimum residential land area, existing before June 27, 2013 but meeting the conditions for granting land use right certificates, the land user shall be granted a certificate.
