Public land is granted certificates to people

According to the report of Cam Ranh City Inspectorate, in 1997, Cam Thanh Nam Commune People's Committee established a plan to separate 5% of the land fund. At that time, Cam Ranh District People's Committee issued a decision to recognize 5% of the land for 93 plots (total area of ​​over ^104,000m2 ), including 89 plots of crop land ( ^90,000m2 ) and 4 plots of extra land (over ^14,000m2 ). During the management process, Cam Thanh Nam Commune People's Committee has converted some areas to other uses according to the needs of local socio-economic development (building markets, making roads or dividing plots). Up to now, the total number of public land plots in the commune is 62 plots. However, through inspection, most of these plots are under the name of the people. Explaining this issue, the leader of Cam Thanh Nam Commune People's Committee said that because the commune previously leased them, when measuring, the people declared them themselves.

The public land area of ​​more than 700m2 has been granted a land use right certificate to Ms. Pham Thi Thanh Thuy.

In addition, through inspection, Cam Ranh City Inspectorate discovered that some public land plots had been granted certificates to the people. Specifically, land plot No. 81, map sheet No. 5 was granted a certificate by Cam Ranh Town People's Committee to Mr. Tran Mot (Quang Hoa village) in 1998, but in 2001, Cam Thanh Nam Commune People's Committee still listed it in the 5% land fund and proposed recognition. Or the case of land plot No. 497, map sheet No. 06 was arbitrarily granted to Ms. Pham Thi Thanh Thuy. Specifically, in 2011, Ms. Thuy and her husband applied for a certificate for this land plot. At the end of 2013, Cam Thanh Nam Commune People's Committee confirmed the legal origin of Ms. Thuy and her husband's land. Although this land plot was recognized as 5% land since 2001, at that time, Mr. Tran Duc Thanh - Chairman of the Commune People's Committee signed a correction petition on behalf of the Commune People's Committee, stating that the recording of public land for this land plot in the inventory book of Cam Thanh Nam Commune People's Committee was a wrong name in order to legalize the issuance of a land plot certificate to Ms. Thuy.

The city inspector also pointed out that the leasing of public land of Cam Thanh Nam commune did not follow procedures and was not in accordance with legal regulations; some public land funds were left vacant but the commune People's Committee did not develop a leasing plan, causing waste of public land and loss of budget revenue. In addition, in the commune, there are many public land plots that have been encroached upon for a long time but have not yet established records for handling administrative violations...

Loose land management

According to the conclusion of the Cam Ranh City Inspectorate, in the process of managing 5% land and other types of land, the People's Committee of Cam Thanh Nam commune is still irresponsible, takes lightly, and loosens land management, allowing shortcomings and violations to occur. Specifically, the People's Committee of the commune does not conduct statistics (once a year), inventory (once every 5 years) of land according to the provisions of Article 53 of the 2003 Land Law, Article 34 of the 2013 Land Law, leading to failure to update and monitor the situation of fluctuations and current status of land use of land plots; loosens the management of Quang Hoa village market land, allowing people to spontaneously trade and encroach on market land. In addition, the People's Committee of Cam Thanh Nam commune has not strictly implemented the instructions of the People's Committee of Cam Ranh City since 2016 on the management of public land and other types of land managed by the People's Committee of the commune to measure, mark, check the current status, prevent and establish records to handle violations. The granting of the land use right certificate to Ms. Pham Thi Thanh Thuy was arbitrary, lacked inspection, and lax management of public land. The responsibility belongs to Mr. Tran Duc Thanh (former Chairman of Cam Thanh Nam Commune People's Committee, currently Vice Chairman of the Commune People's Council), Mr. Nguyen Van An (commune land official) and Mr. Tran Tinh (former Deputy Head of the City Department of Natural Resources and Environment, currently Vice Chairman of Ba Ngoi Ward People's Committee).

The mango garden area was illegally leased by the People's Committee of Cam Thanh Nam commune.

In conclusion, the Chief Inspector of Cam Ranh City recommended that the People's Committee of Cam Ranh City assign the People's Committee of Cam Thanh Nam Commune to conduct statistics to accurately determine the data on types of public land currently assigned by the People's Committee to the commune for management; develop a plan to lease land for construction works approved by competent authorities in accordance with legal regulations in order to use and exploit effectively, avoiding the situation of leaving it vacant for people to build works on the land. In addition, Cam Thanh Nam Commune urgently measures and sets up landmarks to put Quang Hoa village market land under strict management; establish records to handle cases of encroachment on public land. The City Inspector also recommended that the People's Committee of Cam Ranh City assign the Department of Internal Affairs to guide the People's Committee of Cam Thanh Nam Commune and the People's Committee of Ba Ngoi Ward to organize inspections and clarify the responsibilities of organizations and individuals for these shortcomings and violations.

Prevent transfer of wrongly granted land plots

Mr. NGUYEN VAN CHIEN - Chairman of Cam Thanh Nam Commune People's Committee: The locality has sent a document to the People's Committee of Cam Ranh City, the Department of Agriculture and Environment of the city, and the Branch of the Land Registration Office of Cam Ranh City requesting to prevent transactions on the public land plot that had been granted a certificate to Ms. Pham Thi Thanh Thuy. During the process of handling the dossier, on August 21, 2024, the People's Committee of the commune invited Ms. Thuy to cooperate in resolving the case, however, Ms. Thuy did not cooperate to carry out the procedures to return the land to the State. In order to continue to recover public land managed by the People's Committee of the commune, the People's Committee of Cam Thanh Nam commune requested that the agencies not carry out the procedures for registering the transfer of land use rights and assets attached to the land for this land plot.
