The Government has just issued Resolution No. 05/NQ-CP dated January 5, 2024, the Special Session on Law Making in December 2023. In which, the Government gave opinions on 7 proposals for law making, ordinances and 2 draft laws.

Prevent cross-ownership in credit institutions

Notably, regarding the reception, revision and completion of the draft Law on Credit Institutions (amended), the Government requires that the draft Law on Credit Institutions (amended) must ensure that there is sufficient legal basis to regulate the activities of credit institutions; ensure the healthy and sustainable development of credit institutions, serving the development of the country.

The contents of explanation, acceptance and adjustment need to be analyzed in depth, convincing, clearly stating the political basis, legal basis, practical basis of the necessity to promulgate the provisions in the draft Law, removing difficulties and obstacles in the practical operations of credit institutions, preventing cross-ownership, taking advantage of State policies for corruption, negativity, committing other illegal acts; ensuring monetary security, national interests, ethnic interests, rights and legitimate interests of related individuals and organizations.

Strengthen the State management role of the State Bank, the tasks and powers of the Governor of the State Bank in controlling the operations of credit institutions to ensure State management and ensure monetary security.

Clearly define methods for determining land prices

Regarding the reception, revision and completion of the draft Land Law (amended). Specifically, regarding the content of land valuation methods and cases and conditions for applying each method (Article 158), the Government assigned the Ministry of Natural Resources and Environment to complete the draft Law in the direction of clearly stipulating methods for determining land prices; cases and conditions for applying land valuation methods; and at the same time assigned the Government to specify details in the Decree guiding the implementation, ensuring clarity, publicity, transparency and harmony of interests of the State, land users and investors.

Regarding the use of land to implement commercial housing projects (Articles 122 and 127), the Government assigned the Ministry of Natural Resources and Environment to receive comments from Government members and revise this regulation in accordance with the policy in Resolution No. 18-NQ/TW on "Continuing to implement the mechanism of self-negotiation between people and enterprises in transferring land use rights to implement urban and commercial housing projects" and in accordance with reality...

The Government assigned the Ministry of Natural Resources and Environment to urgently receive comments from Government members on the proposals for acceptance, revision, and fully reflect the received content in the draft Law to remove practical obstacles, perfect the mechanism and policies on open land, create conditions for production, business activities and socio-economic development; at the same time, have a mechanism for strict management, inspection and control, avoid loss of state assets, prevent negativity and group interests, ensure the consistency of the legal system, closely coordinate with the agencies of the National Assembly in the process of acceptance, revision, and create consensus when submitting this Law project to the National Assembly in January 2024.

Review and research fire prevention and fighting standards to ensure feasibility.

In particular, the Government basically agreed on 5 policies of the Proposal to develop the Law on Fire Prevention, Fire Fighting and Rescue. The Government requested the Ministry of Public Security to study and absorb the Government's opinions and the opinions of Government members to continue reviewing, studying and further reducing and simplifying administrative procedures; decentralizing and delegating maximum authority to localities to manage, implement and be responsible for fire prevention and fighting work in the area, and at the same time having regulations on handling administrative procedures in the online environment, digital transformation; clearly defining the state management function with the socialized sector.

Review, research, and regulate appraisal activities in this Law in sync with appraisal activities in the construction sector to ensure convenience for people and businesses. Research and regulate to enhance the responsibility of investors in fire prevention and fighting; review and research fire prevention and fighting standards to ensure feasibility, including allowing the application of foreign standards as appropriate.

Along with that, continue to review and classify existing groups of works and facilities that have difficulties, problems, violations, and shortcomings after inspection to have transitional regulations in the Law and assign competent authorities to issue solutions to remove and overcome them in the coming time...

Clearly demonstrate the policy of strengthening decentralization and delegation of power in urban development.

Regarding the Proposal to develop the Law on Urban Development Management, the Government assigned the Ministry of Construction to preside over and coordinate with the Ministry of Justice, the Government Office and relevant ministries and agencies to study and fully absorb the opinions of Government members, revise and complete the dossier of the Proposal to develop the Law according to the following requirements: Continue to summarize legal regulations on urban development management; clarify problems and inadequacies arising in practice to propose appropriate policies, ensuring full institutionalization of the Party's guidelines and policies and the State's policies on urban development management.

Review to clearly define the scope of regulation, policy content and implementation solutions in the Proposal for Law development, ensuring a comprehensive and holistic approach to urban development management, ensuring consistency and synchronization with the provisions of the Law on Planning, Law on Investment, Law on Public Investment, Law on Construction, Law on Environmental Protection, Law on Capital, Law on Land, Law on Housing, draft Law on Roads, draft Law on Urban and Rural Planning, and other relevant Laws and Law projects.

Research and revise the name, content, solutions for implementing the policy, the detailed outline of the Law, ensuring consistency in the Government's guidelines and orientations when drafting this Law. The content and solutions for implementing the policy must clearly demonstrate the policy of strengthening decentralization and delegation of power, ensuring the effectiveness and efficiency of state management in urban development management; promoting the application of science and technology and digital transformation; innovating management, inspection and supervision methods to minimize administrative procedures, ensuring convenience for people and businesses.

Clearly explain the specific content of each policy, its social, economic and legal significance when promulgating policies and provide specific evidence of the necessity of developing this Law according to each policy content, such as: urban classification, urban assessment, urban model; compliance requirements when building new urban areas, renovating and embellishing urban areas, the connection between urban areas to form a green, modern and sustainable urban system, etc.
