Notice of the Ministry of Labor - Invalids and Social Affairs, civil servants, public employees and employees at administrative agencies, public service agencies, political organizations, socio-political organizations are off for National Day 2023 from Friday (September 1) to Monday (September 4).
This holiday includes 2 National Day holidays, 1 weekly day off and 1 compensatory day off for the weekly day off as prescribed in Clause 3, Article 111 of the Labor Code.
Agencies and units that do not have a fixed weekly Saturday and Sunday off schedule must arrange a suitable, legal holiday schedule based on the specific program and plan of the unit.
For employees who are not civil servants or public employees, the employer decides to choose the National Day holiday option in 2023.
Accordingly, workers will have Saturday, September 2 off and choose one of two days: Friday or Sunday.
If the weekly day off coincides with a public holiday or Tet holiday, the employee is entitled to take the weekly day off in lieu on the next working day according to the provisions of the Labor Code.
Thus, the holiday schedule for employees on the occasion of National Day September 2 is as follows:
For employees whose weekly day off is Sunday, if they choose to take Friday (September 1) off, the National Day holiday will start from Friday (September 1) to Sunday (September 3).
If you choose to take Sunday (September 3) off, the National Day holiday will start from Saturday (September 2) to Monday (September 4).
For employees who have 2 days off on the weekend (Saturday and Sunday), if they choose to take Friday (September 1) off, the National Day holiday will start from Friday (September 1) to Monday (September 4).
If you choose to take Sunday (September 3) off, the National Day holiday will start from Saturday (September 2) to Tuesday (September 5).
Thus, the National Day holiday schedule on September 2, 2023 will last from 3 to 4 days, depending on the working regime of the employees.
During the National Day holiday, employees are entitled to take a day off with full pay. In case employees work overtime, they are paid according to the unit price of the salary or actual salary paid according to the work being done.
Specifically, employees working on weekdays are paid at least 150%; on weekly days off, at least 200%; on holidays, Tet, and paid leave days, at least 300%, not including holiday, Tet, and paid leave wages for employees receiving daily wages.
In case an employee works at night, he/she shall be paid an additional amount of at least 30% of the salary calculated according to the unit price of salary or actual salary paid for the work of a normal working day.
Enterprises that arrange for employees to work overtime at night shall, in addition to paying wages according to regulations, be paid an additional 20% of wages calculated according to the unit price of wages or salaries for work done during the day on a normal working day or a weekly day off or a holiday or Tet holiday.
