Submitted to the National Assembly for the first time at the 6th Session (October 2023), the Draft Law on the Capital (amended) was basically approved by National Assembly deputies regarding the necessity, purpose, viewpoints on amending the Law and the main content of the draft Law.

After the Session, the Standing Committee of the National Assembly directed the Standing Committee of the National Assembly's Law Committee to preside over and coordinate with the drafting agency and relevant agencies to synthesize and study the opinions of National Assembly deputies. At the same time, organize working sessions with relevant ministries, branches and agencies; send representatives to participate in a number of seminars, discussions, and consult experts, scientists and managers to have more information and practical basis to serve the work of explaining, receiving, revising and perfecting the Draft Law.

The content of the explanation, acceptance and revision of the draft Law was commented on by the National Assembly Party Delegation and the National Assembly Standing Committee at the meeting in March 2024; then it was accepted and revised to be submitted for comments at the 5th Conference of full-time National Assembly deputies (March 2024) and sent for comments to the National Assembly delegations, the Ethnic Council, the National Assembly Committees and relevant agencies. At the same time, the Draft Law was revised and finalized for submission to the National Assembly on the basis of accepting the Government's comments.

After being absorbed and revised, the Draft Law on the Capital (amended) has 7 chapters and 54 articles. The Draft Law has supplemented and revised many contents to implement the policy of strongly strengthening decentralization for the Hanoi City government in a number of areas.

Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that in order to ensure consistency and synchronization, the Draft Law has collected, supplemented and rearranged the provisions on principles and specific contents on decentralization and delegation in the Draft Law submitted by the Government to stipulate in a separate article, ensuring clarity on subjects, objects, contents and responsibilities in decentralization and delegation, replacing the application of provisions on decentralization and delegation under the Law on Organization of Local Government.

Secretary General of the National Assembly, Head of the National Assembly Office Bui Van Cuong commented that in a short time, the National Assembly's Law Committee coordinated with relevant agencies to quickly complete the dossier with very significant changes in content and legislative techniques. The dossier of the draft Law was sent to National Assembly deputies for study before the 7th Session, ensuring compliance with the prescribed time.

Basically, the Draft Law on the Capital (amended) submitted to the National Assembly at the 7th Session is highly complete, without any content requiring multiple options for the National Assembly to discuss and choose; that is, there is no content with different opinions causing difficulties for the legislative process.

Become the driving force for the development of the whole region and the country

According to National Assembly delegate Nguyen Tao (Lam Dong Province Delegation), the scope of application of the Draft Law is relatively comprehensive, covering most areas, including local government organization, decentralization, inter-regional development linkage, etc. The "priorities of application" in the legal system will determine the effectiveness and enforcement of the Capital Law after it is promulgated.

Delegate Hoang Van Cuong (Hanoi Delegation) commented that the Draft Law on the Capital (amended) has fundamental and breakthrough changes with the spirit of giving more decision-making power to the Capital in promulgating standards, regulations, and decisions that are different from the general regulations of the whole country.

At this session, in addition to reviewing and approving the Law on the Capital (amended), the National Assembly will give opinions on the Hanoi Capital Planning for the period 2021 - 2030, with a vision to 2050 and the Project to Adjust the Hanoi Capital Master Plan to 2045, with a vision to 2065. In order to create a development orientation and breakthrough according to the proposed planning options, there must be mechanisms and policies to exploit, mobilize and make the best use of resources for development. Mechanisms and policies to exploit and create the best resources for the development of the Capital must be institutionalized into a legal framework.

"The National Assembly's consideration of these three contents together not only creates development orientations, but also proposes implementation options and provides them within a legal framework to create changes and breakthroughs for the capital in the coming time" - delegate Hoang Van Cuong expressed his opinion.

Meanwhile, delegate Tran Van Lam (Bac Giang Province Delegation) assessed that the development of the Capital has always been a source of pride for the whole country. The capital of Vietnam is on par with the capitals of other countries, contributing to raising the position of Vietnam to stand shoulder to shoulder with other countries. The completion of the Draft Law on the Capital (amended) is to create a spreading force, becoming a driving force for the development of the whole region as well as the country.

The draft Law also specifically stipulates preferential policies for Hoa Lac High-Tech Park. According to Deputy Head of the National Assembly's Law Committee Nguyen Phuong Thuy, this demonstrates the core role of Hoa Lac High-Tech Park in the synchronous development of high-tech parks in the city; at the same time, it is also a step to continue preferential policies after the Ministry of Science and Technology transferred Hoa Lac High-Tech Park to the Hanoi People's Committee for management. The draft Law also determines that investment in urban railways in Hanoi is prioritized to apply the urban development model according to public transport orientation (TOD) with a number of specific policies.

With a fairly comprehensive scope of regulation, the Draft Law on the Capital (amended) is expected to contribute to perfecting the legal system and ensuring synchronous, unified, effective and efficient law enforcement with priority and outstanding mechanisms and policies for the development of the Capital.
