Hai Phong, Dong Nai and Khanh Hoa have new regulations on land subdivision and separation.

(Dan Tri) - Hai Phong City, Dong Nai and Khanh Hoa provinces have issued new decisions on regulations on conditions and minimum areas for land division after the 2024 Land Law takes effect.


Minimum area after land division in Hai Phong is 40m2

Hai Phong City People's Committee has just issued Decision 31/2024 guiding the 2024 Land Law. According to Article 11 of this decision, for land in urban areas, the minimum area of ​​a newly formed land plot is 40 square meters.

In which, the width of the road-facing side and the walkway-facing side of the newly formed land plot is at least 3.5m, the depth inside the newly formed land plot is at least 3.5m and the newly formed land plots must ensure that the narrowest cross-section of the land plot is greater than or equal to 2m.

For rural areas, the minimum area of ​​a newly formed residential plot is 60m2. Of which, the width of the road-facing side and the walkway-facing side of the newly formed plot must be at least 4m, the depth inside the newly formed plot must be at least 4m, and the newly formed plots must ensure that the narrowest cross-section of the plot must be greater than or equal to 3.5m.

Minimum area after land division in Khanh Hoa is 36m2

Khanh Hoa Provincial People's Committee has just issued Decision No. 29 specifying the conditions, size and minimum area for land division and land consolidation for each type of land in the province.

According to the decision, the consolidation and separation of land plots must comply with the principles and conditions in Article 220 of the 2024 Land Law. In addition, the land plot to be consolidated or separated must also ensure the prescribed minimum conditions, size, and area.

For urban residential land, the plot of land is adjacent to a traffic road with a red line width (planning) of 19m or more, the minimum area to be divided must be 45m2 or more and the frontage width and depth of the plot of land must be 5m or more.

Land plots adjacent to traffic routes with a red line (planning) width from 10m to less than 19m, the minimum area to be divided must be from 36m2 or more and the frontage width and depth of the land plot must be from 4m or more. Land plots adjacent to traffic routes with a red line (planning) width under 10m, the minimum area to be divided must be from 36m2 or more and the frontage width and depth of the land plot must be from 3m or more.

For rural residential land, land plots adjacent to national highways, provincial roads, district roads, and communal roads must have a minimum area of ​​50 square meters or more and the frontage width and depth of the land plot must be 5 meters or more.

The minimum area of ​​land plots to be divided in the island area must be from 50m2 or more and the frontage width and depth of the plot must be from 5m or more. The minimum area of ​​land plots to be divided in the remaining area must be from 60m2 or more and the frontage width and depth of the plot must be from 5m or more.

In case of separating residential land plots or land plots with residential land and other land in the same plot in a residential area, it is necessary to arrange access to the plots after separation, it must be agreed upon between the users of the separated plots but must ensure the minimum width of the access is 1.5m.

In case of land division not belonging to residential areas but having to arrange a walkway, the width of the walkway shall be agreed upon between the owners of the divided land plots but must meet the minimum width of the common walkway of 4m.

The minimum area after land division in Dong Nai province is 60m2

Dong Nai Provincial People's Committee has just issued Decision 63/2024 specifying the conditions and minimum area for land division and land consolidation for each type of land in the province.

According to the decision, for urban land, the minimum area after subdivision is 60m2 (including Long Hung commune, Bien Hoa city). For rural land, the minimum area after subdivision is 80m2. Regarding the conditions, the land after subdivision must be adjacent to a traffic road.
