Hanoi People's Committee informed: While land for building schools in the inner city is difficult, there are still agencies, enterprises, factories, cooperatives... that were previously allocated land by the State but used it ineffectively.

Specifically: Dong Tam ward has a land plot of Dien May company at 163 Dai La which is currently being leased as a supermarket (while Dong Tam kindergarten is temporarily borrowing land from Truong Dinh ward); Bach Mai ward has 2 land plots at 418 Bach Mai which were assigned by the State to Dien Thong Engineering Company but the Company does not use it for production and is currently being leased to another unit as a warehouse; Vinh Tuy ward has a location at 14 Mac Thi Buoi which was previously assigned to the Northern Food Company but is currently being left to waste.

Therefore, all three plots of land are being proposed for school construction.

Land of Dien Thong Engineering Company at 418 Bach Mai Street

Specifically, the land of the Electrical Appliances Company at 163 Dai La Street (area of ​​about 2,170.63m² remaining after site clearance for the Ring Road 2 project) managed and used by the Electrical Appliances, Bicycles and Motorbikes Joint Stock Company is determined to function as public land for residential units.

On July 7, 2017, the City People's Committee issued an Official Dispatch approving in principle the adjustment of function from public residential land to Kindergarten land according to the proposal of Hai Ba Trung District People's Committee and the report of the Department of Planning and Architecture.

After receiving instructions from the City People's Committee, the Department of Planning and Architecture requested the Hai Ba Trung District People's Committee to complete the dossier. However, the Electrical Appliances Joint Stock Company did not agree with the school construction plan and requested to keep the land on the grounds that there was no longer an office or working headquarters, affecting the lives of the Company's staff.

The Department of Planning and Architecture has issued Official Dispatch No. 5310 guiding the People's Committee of Hai Ba Trung District on the above contents to have a basis for appraisal and submission to the City People's Committee for consideration and approval of the Local Adjustment of the Urban Zoning Plan, as a basis for the People's Committee of Hai Ba Trung District to implement investment procedures for the construction of a Kindergarten on the land according to regulations.

Regarding the land of Dien Thong Engineering Company at 418 Bach Mai Street (with a total area of ​​about 7,070.6m²) managed and used by Elinco Dien Thong Engineering Company, the Hanoi City People's Committee said that the above land is located in the area with oriented land use functions: Kindergarten land, Primary school land and traffic roads according to the planning.

According to the Hanoi People's Committee, the voters' proposal to build a school at land plot number 418 Bach Mai Street is in line with the approved urban zoning plan.

Regarding the land of the Northern Food Company at 14 Mac Thi Buoi Street, managed and used by the Northern Food Company (with an area of ​​about 7,545m²), a part of the land area (Southwest) is within the planned road opening area, the majority of the remaining area is within the area oriented as high school land (area of ​​about 6,900m²).

According to the Hanoi People's Committee, the voters' proposal to build a school at land plot No. 14 Mac Thi Buoi Street is in line with the approved urban zoning plan.

Regarding the proposal to reclaim land, the Hanoi People's Committee said that the consideration and decision to reclaim land due to violations of land laws as prescribed in Article 64 of the 2013 Land Law must follow the procedures for reclaiming land as prescribed in Article 66 of Decree No. 43/2014/ND-CP of the Government.
