(Chinhphu.vn) - The Ministry of Home Affairs proposed that public service units with a high level of autonomy will have the right to decide on the number of employees; increase the level of autonomy in recruitment, use, management, planning, and appointment for heads of public service units.

The Ministry of Home Affairs has completed the draft Law on Civil Servants (amended) and is seeking comments from domestic and foreign agencies, organizations and individuals.

One of the notable points is that the draft Law on Civil Servants (amended) has focused on reviewing and supplementing policies in the direction that public service units are proactive in managing and using human resources, in line with the new policy of the Politburo and reality.

The goal is to create a flexible mechanism in recruitment so that public service units can attract, arrange, use, reward, train and foster civil servants, workers, experts and scientists, in accordance with the human resource needs and financial conditions of the unit; allow service units to operate as economic entities (for autonomous units); create a flexible mechanism in recruitment, evaluation and use in accordance with the level of autonomy on the basis of ensuring the principle of serving the community; create a sufficiently open mechanism so that each unit can "design its own" way of managing, using and recruiting its staff.

Specifically, the principle of decentralization and delegation of authority will be implemented in accordance with the level of autonomy of the public service unit, ensuring comprehensive initiative in personnel associated with the responsibility of the head of the public service unit in operating and managing personnel and other resources to best serve professional tasks to meet the requirements of providing public services, ensuring quality and efficiency in serving society.

Accordingly, public service units with a high level of autonomy will have the right to decide on the number of employees; increase the level of autonomy in recruitment, use, management, planning, and appointment for heads of public service units.

Public service units choose appropriate forms of civil servant recruitment according to the level of autonomy, requirements of the job position and characteristics of the unit.

Public service units can sign direct contracts with experts, scientists, and talented people suitable for the unit's field of operation, creating favorable conditions for the unit to attract high-quality, experienced and specialized personnel that the traditional recruitment process may not be able to meet.

Public service units can accept as civil servants those with experience that immediately meets the requirements of the job position currently working in the non-public sector, helping the unit supplement a team of capable personnel, ready to start work, saving time and initial training costs.

Public service units are proactive in developing their own assessment, salary, bonus and discipline regulations, closely following the specific tasks, organizational model and goals of each unit, thereby making the assessment fairer, more objective and effective, encouraging civil servants to maximize their capacity.

Another notable point in the draft law is the regulation of specific registration conditions for cases where Vietnamese citizens are living abroad or foreign citizens are living in Vietnam, which are implemented according to the decision of the competent authority; regulations on priority selection of talented people, people with meritorious services to the country, and ethnic minorities; application of science and technology in the recruitment process; integration with unified civil servant management data in each sector and field.

Regarding the probationary period, the successful candidate must undergo probationary period, except in cases where he/she has completed 12 months or more of professional experience appropriate to the requirements of the recruited job position.

The Draft Law also expands the rights of civil servants, accordingly, civil servants are allowed to sign contracts to perform professional activities at public service units other than the public service unit they are currently working for; are allowed to contribute capital, establish, manage, operate, and work at enterprises established by the public service unit they are working for or participate in establishing to commercialize research results, effectively exploit intellectual property, inventions and digital technology created by that organization; are sent to work at scientific and technological organizations, higher education institutions, enterprises and other organizations for a certain period of time; are allowed to contribute capital, establish, participate in management, operation or participate in technology development at domestic and foreign enterprises...
