Latest conditions for land subdivision and separation in Long An province

(Dan Tri) - From November 6, in Long An, the minimum area after land division of residential land ranges from 25-100m2, agricultural land 500-1,000m2, industrial land 2,000m2.


The People's Committee of Long An province has recently issued Decision No. 49/2024 regulating the conditions for land division, land consolidation and the minimum area for land division for some types of land in the area. The new decision takes effect from November 6, 2024.

According to the decision, for residential land adjacent to public transport routes with red lines greater than or equal to 19m, the minimum area after subdivision in urban areas is 45m2, in rural areas is 100m2. For residential land adjacent to public transport routes with red lines less than 19m, the minimum area after subdivision in urban areas is 36m2, in rural areas is 80m2.

Residential land adjacent to public roads or walkways but not yet specified with red lines, the minimum area after subdivision in urban areas is 80m2, in rural areas is 100m2.

Agricultural land, the minimum area after subdivision in communes in Duc Hue, Thanh Hoa, Tan Thanh, Moc Hoa, Vinh Hung, Tan Hung districts is 1,000m2. In other areas, the minimum area is 1,000m2 for rice fields and production forest land, 500m2 for the remaining agricultural land types. For industrial park land, industrial clusters, the minimum area after subdivision is 2,000m2.

For commercial, service land and non-agricultural production land, if the land plot is located in an area with approved detailed construction planning, the newly formed land plot must ensure the area according to the detailed construction planning. If the land plot is located in an area with unapproved detailed construction planning, the newly formed land plot and the remaining land plot must ensure a minimum area of ​​1,000m2.

In addition, Long An province also regulates 4 other cases of land division.

Firstly, separating residential land plots to transfer land use rights where the land users are poor households, near-poor households, or households in especially difficult circumstances.

Second, the residential land plot meets the conditions for subdivision and the minimum area for subdivision but was previously donated by a household or individual or agreed to recover part of the land plot (without compensation) for public use.

Third, separating residential land plots to implement the act of parents giving land use rights to their children, inheriting land use rights and assets attached to the land.

Fourth, separating existing residential land plots adjacent to public transport routes, ensuring conditions for separation, ensuring water supply, drainage and electricity supply, ensuring housing construction area but not ensuring conditions on land plot size or not ensuring conditions on minimum area.

In these cases, the locality stipulates that the newly formed land plot and the remaining land plot after deducting the land area within the red line boundary and the area within the vicinity of the protected construction area must ensure a minimum width and depth of 4m, and a minimum area of ​​25m2. At the same time, the land user is only allowed to consider and resolve the land plot separation once.
