Hai Ninh Ward is a locality with a large area and large population, ranking second among the wards and communes of Nghi Son town with a total of more than 5,100 households and 19,000 people.
Thanh Cao residential area, Hai Ninh ward (Nghi Son town) has many plots of land that were illegally allocated since 1995 and have not been granted land use right certificates.
As of early 2024, the ward has 2,472 land plots of households and individuals that have not been granted land use right certificates (LURCs) for the first time; of which, land used before October 15, 1993 is 120 cases, land allocated without proper authority is 202 cases (10 cases are eligible for LURCs); agricultural land after land consolidation and plot exchange (DED) is 2,150 cases. In 2024, the ward is assigned the target of completing the application for granting LURCs for 360 cases, including 15 cases of land recognized by the State for LURCs; 5 cases of land allocated without proper authority and 340 cases of agricultural land after DED.
Chairman of Hai Ninh Ward People's Committee Le Dinh Phuong said: Nghi Son Town People's Committee has paid attention to and promptly resolved difficulties in regulations and working procedures, creating favorable conditions for wards and communes in determining land origin and guiding people to prepare documents to be granted land use right certificates. In 2023, Hai Ninh Ward is one of the units that successfully completed the task of granting land use right certificates to households and individuals in the area, reaching 135% of the assigned plan. To complete the assigned plan and targets in 2024, from the beginning of the year, the Ward People's Committee has organized to determine the land origin for 26 cases (4 cases of first-time issuance, 20 cases of land recognized by the State for land use right and 2 cases of land allocated without proper authority before July 1, 2004 with payment receipts). For agricultural land after the land acquisition, the Ward People's Committee is reviewing and comparing data for each land plot and preparing documents to request a land use right certificate.
According to the review results up to the end of December 2023 of Nghi Son town, there are still many households in the town that have not been granted land use right certificates for the first time and agricultural land use right certificates after the land reclamation. Specifically, for residential land with land use origin before October 15, 1993, the rate of granting new land use right certificates reached 95.83%; there are still more than 2,300 cases that have not been granted land use right certificates. For residential land in cases of improper allocation, there are still about 3,400 cases, of which more than 340 cases are eligible but have not been granted land use right certificates. For agricultural land after the land reclamation, there are still more than 46,000 plots of land that need land use right certificates. This is hindering land management in localities, affecting site clearance and easily causing land-related disputes, affecting the legitimate rights and interests of the people.
Faced with this situation, since 2023, Nghi Son town has focused on guiding and developing a plan to issue land use right certificates in the spirit of determination to remove obstacles, gradually resolve backlogs, and promptly issue land use right certificates to people according to regulations. The goal set by Nghi Son town is to basically resolve the backlog of land use right certificates for people within 3 years.
In 2023 alone, in the town, there were 165 cases of residential land used before October 15, 1993 and residential land allocated without proper authority being granted land use right certificates. In 2024, continuing to carry out the above tasks, Nghi Son Town People's Committee has developed Plan No. 86/KH-UBND dated February 16, 2024 on granting land use right certificates for the first time, land allocated without proper authority and agricultural land after land use planning.
According to the plan, the town aims to issue new certificates for residential land formed before October 15, 1993, which is 373 certificates; issue certificates for 69 cases of land allocated without proper authority; issue and re-issue 7,385 cases of agricultural land in 13 communes and wards implementing the DDĐT that have measured cadastral maps of agricultural land; issue 100% of certificates to cases that won the auction of land use rights and cases that have been allocated resettlement land and have paid full land use fees. The huge amount of work demonstrates the high determination of Nghi Son town in the work of issuing land use rights certificates.
Nghi Son Town People's Committee has proposed many implementation solutions, in which the Department of Natural Resources and Environment is the standing agency, taking the lead in advising on the work of granting land use right certificates, proactively urging, inspecting, and supervising the progress of preparation, submission, and appraisal according to the procedures and responsibilities of each agency and unit. Every month, it is necessary to organize meetings twice or ad hoc meetings between the Department of Natural Resources and Environment, Nghi Son Land Registration Office Branch, People's Committees of related communes and wards, and the problem-solving team to grasp and promptly resolve difficulties, urge the implementation progress, clearly assign responsibilities in each specific stage of work to avoid the situation of pushing, avoiding, making it easy to do but difficult to abandon... Strengthening the synchronous coordination between the town and the Branch of the Town Land Registration Office. The People's Committees of communes and wards are responsible for notifying and receiving applications for land use right certificates from people to determine the origin, time of land use, determine the legality of the land, compliance with planning... register land to prepare records, submit to the People's Committee of the town to issue land use right certificates to eligible cases.
