New residential land construction will be resolved

Accordingly, the Ho Chi Minh City Inspectorate has sent a document to departments and localities requesting reports on the situation of people's complaints and feedback related to the planning area with the function of new residential land construction. The complaints start from January 1, 2018 to May 31, 2023. The report must be sent back to the City Inspectorate by June 9 at the latest.

Previously, Vice Chairman of Ho Chi Minh City People's Committee Bui Xuan Cuong had a meeting with relevant departments and agencies regarding complaints and concerns of people about newly built residential land.

Regarding this issue, Thanh Nien Newspaper has published many articles reflecting the frustrations of people who have houses and land in new residential land planning projects that have been refused permission to change the purpose, separate plots, and grant construction permits.

The city has more than 14,000 hectares of land in the mixed-use planning and newly built residential land.

It is worth mentioning that the term "newly built residential land" is not included in legal documents, the Land Law, the Housing Law... but was created by Ho Chi Minh City itself, along with the term "mixed land", which has made people miserable since the beginning of 2018 when Decision 60 regulating the minimum area for land division issued by the City People's Committee took effect.

According to preliminary statistics, in Binh Chanh district, nearly 15,000 hectares of land are planned as newly built residential land, with nearly 13,500 households affected. In Binh Tan district, according to statistics from 1/2000 zoning plans in the district, there are a total of 155 land plots being planned with two functions: newly built residential land and mixed land with a scale of more than 341 hectares. Binh Tan district People's Committee admits that the settlement of people's needs in these two planning functions is currently very limited, affecting their legitimate rights and interests in land.

A recent report from the Department of Planning and Architecture shows that the entire city has more than 14,000 hectares of land in the mixed-use planning and newly built residential land. With the scale of the above two types of land, there may be thousands of individuals and households who have not been able to carry out the procedures for land division according to their needs in the past.

Regarding Decision 60, although it is still in effect, almost all localities in Ho Chi Minh City do not apply it. The Department of Natural Resources and Environment of Ho Chi Minh City has long said that it has submitted to the Ho Chi Minh City People's Committee a draft amendment to Decision 60, but to date this decision has not been implemented, causing people's rights to remain "suspended".

Many people expect that this time, the Ho Chi Minh City People's Committee will remove obstacles for residents building new and mixed-use land to return rights to the people.
