Delegate of Nghe An: People send petitions to the National Assembly, National Assembly deputies do not want to ask deputies to do 'postman' work

That was the analysis of delegate Thai Thi An Chung - Member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Nghe An when speaking at the discussion on the results of receiving citizens, handling petitions and resolving complaints and denunciations of citizens in 2023 at the 6th Session of the 15th National Assembly. Thereby, the delegate recommended that the National Assembly Standing Committee promptly study and amend regulations on classification and handling of complaints and denunciations of elected bodies.

SOON COMPLETE THE NATIONAL DATABASE SYSTEM ON COMPLAINTS AND DENUNCIATIONS

Speaking at the discussion, delegate Thai Thi An Chung - Member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Nghe An said that she basically agreed with the comments and assessments on the results achieved, limitations and shortcomings in the work of receiving citizens, handling complaints and denunciations and supervising the handling of complaints and denunciations sent by citizens to the National Assembly and agencies of the National Assembly; at the same time, she raised a number of recommendations.

First of all, regarding upgrading and perfecting the National Database on Complaints and Denunciations, on November 15, 2022, the National Assembly passed Resolution No. 75/2022/QH15 on questioning activities at the 4th Session, which includes the content requiring the Government, the Prime Minister, Ministers, and Heads of ministerial-level agencies to focus on implementing solutions to overcome existing problems and limitations in the inspection field, namely: "Upgrading and perfecting the National Database on Complaints and Denunciations, ensuring data connection nationwide and interconnectivity throughout the system of Party agencies, the National Assembly, the Government, judicial agencies and the Vietnam Fatherland Front".

However, according to the delegate of Nghe An delegation, after 1 year of implementation, in Report No. 562 dated October 17, 2023 of the Government when assessing the existing problems and limitations, it was still determined that: The application of information technology in the work of receiving citizens, handling complaints and denunciations still has many shortcomings; many ministries, branches and localities have not regularly updated data into the National Database system on complaints and denunciations; some ministries, branches and localities have previously proactively built and used a separate software system to monitor the reception of citizens' complaints and denunciations but have not been linked and connected to the National Database system on complaints and denunciations.

What the delegates are concerned about is that the report only states the very simple reason: inadequate investment, lack of synchronization and connection. Therefore, in the section on directions, tasks and solutions for the following years, only quite general contents are given: research, have a plan to implement the upgrading and expansion of the National Database System on complaints and denunciations to ensure compliance with the requirements in the Resolutions of the National Assembly and the National Assembly Standing Committee".

“In my opinion, the progress of upgrading and expanding the National Database system on citizen reception and complaint and denunciation settlement is slow, and there is no specific roadmap to put the National Database on complaints and denunciations into operation to meet the requirements of the National Assembly,” said delegate Thai Thi An Chung.

Every year, with hundreds of thousands of citizens coming to state agencies to make complaints, denunciations, recommendations and reflections, and with the number of complaints, denunciations, recommendations and reflections increasing, the application and exploitation of information data from the National Database on complaints and denunciations not only effectively serves the work of receiving citizens and resolving complaints and denunciations by competent agencies, but also contributes to overcoming the situation that the report of the National Assembly Standing Committee pointed out through supervision: "Many cases have been resolved beyond their authority, in accordance with legal regulations, have been reviewed by central and local agencies, and have been notified of the termination of acceptance and resolution, but some agencies still forward requests for review of the case without clearly stating the basis and reasons, leading to difficulties, creating pressure on competent agencies to resolve".

Pointing out the benefits of completing the National Database on Complaints and Denunciations, the Deputy Head of the National Assembly Delegation of Nghe An province suggested that the Government and the Government Inspectorate need to clarify the causes of the above-mentioned shortcomings and limitations, which are, in addition to the lack of adequate investment, what are the other objective and subjective causes, in order to soon have solutions to overcome them and commit to the completion schedule to avoid wasting time and effort of the people as well as officials and civil servants.

RESEARCH ON AMENDMENTS TO THE REGULATIONS ON CLASSIFICATION AND HANDLING OF COMPLAINTS AND DENUNCIATIONS BY ELECTED AGENCIES

Regarding some solutions to improve the quality of citizen reception, handling of petitions and letters and supervising the settlement of complaints and denunciations sent by citizens to the National Assembly and its agencies, from the practical work of citizen reception, handling of petitions and letters, supervising the settlement of complaints and denunciations by the National Assembly delegation and individual National Assembly deputies, delegate Thai Thi An Chung said that there were some shortcomings and suggested that the National Assembly and the National Assembly Standing Committee pay attention to resolving them.

First of all, in the Resolutions of the National Assembly Standing Committee regulating the reception of citizens, handling of petitions and letters, and supervision of the settlement of complaints and denunciations by elected bodies and elected representatives, there are no regulations on the classification of petitions for elected bodies.

According to Report 665 of the National Assembly Standing Committee, in 2023, the agencies of the National Assembly, the National Assembly Standing Committee, and the National Assembly Delegations received a total of 31,179 petitions from citizens under their responsibility to handle, of which 13,551 petitions were eligible for processing (43.46%) and 17,628 petitions were not eligible for processing (56.54%). The classification of these petitions is based on the provisions of Clause 2, Article 6 of Circular No. 05/2021/TT-TTCP dated October 1, 2021 of the Government Inspectorate.

“The classification of petitions for processing or not processing by elected bodies is similar to that of competent authorities, which will lead to the fact that if the regulations on petitions that are not eligible for processing are thoroughly applied, including: “Petition sent to many agencies, organizations, units, individuals, including agencies, organizations, units or persons with the authority to handle”, then in reality the number of petitions eligible for processing will be very small”, Ms. Thai Thi An Chung pointed out the inadequacies and added: Because, the majority of citizens when sending petitions to agencies of the National Assembly, the National Assembly Standing Committee, and National Assembly Delegations have been considered, resolved, and responded to by competent authorities; however, they find it unsatisfactory.

“With the same content, but the petition sent to the National Assembly agency, the National Assembly deputies do not want the deputies to act as “postmen” but want the National Assembly, the National Assembly delegations, and the National Assembly deputies to urge, supervise, and monitor whether the settlement is in accordance with the provisions of the law or not? Therefore, I recommend that the National Assembly Standing Committee soon study and amend the regulations on classifying and handling complaints and denunciations of elected agencies,” said the delegate from Nghe An.

The Deputy Head of the National Assembly Delegation of Nghe An province also proposed that the National Assembly Standing Committee continue to strengthen training and foster knowledge and skills for elected representatives and staff, civil servants advising and assisting the National Assembly Delegations on this content in the coming time because the work of receiving citizens and handling petitions is a difficult and complicated task, requiring a solid grasp of legal knowledge and skills in handling situations.

Delegate Thai Thi An Chung also agreed with the delegates' recommendation to the National Assembly Standing Committee to study and direct the development, completion and use of a database software for managing petitions and letters for common use among the National Assembly agencies and National Assembly delegations to facilitate the management, storage, processing of petitions and letters and to monitor, urge and supervise the settlement of petitions and letters.
