Green buildings face many legal barriers in Vietnam

Speaking at the opening of the Forum, Deputy Minister of Construction Pham Minh Ha said: Green transformation along with digital transformation is a trend taking place globally and in Vietnam. Green transformation is the process of building an economy with low to very low emissions, achieved through civilized development, economical and efficient use of natural resources.

In particular, green transformation aims to reduce ecosystem degradation and negative impacts on the environment. The main goals of green transformation include increasing energy efficiency, reducing carbon emissions, promoting sustainable use of natural resources, minimizing environmental pollution and enhancing social participation.

According to the Deputy Minister, CTX has appeared in Vietnam for more than 15 years and from the first CTXs in Ho Chi Minh City, by mid-2024, Vietnam had nearly 500 CTXs in many provinces and cities across the country..., showing that the potential for CTX development in Vietnam is still very large...

Besides the policies of the Party, State, Government and the motivation from international commitments and activities on implementing the goal of reducing greenhouse gas emissions, the development of CTX in Vietnam in recent times has also encountered many difficulties and barriers.

Specifically, new CTX is being implemented in the form of incentives, there are no mandatory regulations, the technical level, technology and financial capacity of investors are still limited, and it is difficult to access green finance sources for CTX projects...

Meanwhile, a representative of Van Phu Invest also said that the enterprise still faces difficulties in accessing capital; design consulting capacity is still limited, forcing it to hire foreign consultants to synchronize standards with Vietnam.

There are also limitations in the choice of construction materials. Furthermore, customers are not yet fully aware of the role and benefits of green buildings.

“With the above difficulties, state agencies need to increase propaganda on this issue, creating favorable conditions for businesses…”, emphasized a representative of Van Phu Invest.

Mr. Vu Ngoc Anh, Director of the Department of Science, Technology and Environment of the Ministry of Construction, said that in Vietnam, in recent years, CTX has grown rapidly and is very potential and diverse with many types of constructions, from houses, offices, hotels, etc.

In fact, the Ministry of Construction has issued Circulars to guide specialized agencies to remove difficulties. However, the development of CTX still faces some barriers in terms of legal corridors, lack of human resources, energy saving, high investment costs, etc.

Currently, the Ministry of Construction has issued standards on energy saving; reviewed and issued new basic standards to help investors, project owners, and enterprises more deeply and fully understand their roles and responsibilities in investing, constructing, managing, and operating projects and works according to standards of energy-efficient works, green works, and green cities, aiming to increase quality, convenience, ensure user health, energy efficiency, and environmental protection.
