On July 17, the Government issued Decree No. 48/2023/ND-CP amending and supplementing a number of articles of Decree No. 90/2020/ND-CP dated August 13, 2020 on assessment and classification of the quality of cadres, civil servants and public employees.
This Decree comes into force from September 15, 2023.
No review will be made for cases where quality classification results have been obtained before the effective date of this Decree. In cases where competent authorities have reviewed, evaluated, and classified the quality of cadres, civil servants, and public employees before the effective date of this Decree, the provisions of law at that time shall continue to be applied for implementation.
Supplementing principles for evaluating and classifying the quality of cadres, civil servants and public employees
Regulations on principles for evaluating and classifying the quality of cadres, civil servants and public employees, in addition to the 4 principles prescribed in Decree No. 90/2020/ND-CP, Decree 48/3023/ND-CP has added 2 more principles.
Firstly, cadres, civil servants and public employees subject to party or administrative discipline will have their quality assessed and classified as follows:
Cadres, civil servants and public employees who are subject to party or administrative discipline in the year of assessment will be classified as having failed to complete their tasks.
In case the violation has not been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.
In case a cadre, civil servant or public employee is a party member and has been subject to party discipline and administrative discipline for the same violation, but the party discipline decision and the administrative discipline decision do not take effect in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.
Second, the proportion of cadres, civil servants and public employees classified as "Excellently completing tasks" out of the total number of cadres, civil servants and public employees at the same agency, organization or unit and for each group of subjects with similar tasks must not exceed the proportion of Party members classified as "Excellently completing tasks" according to Party regulations.
In case an agency, organization or unit has outstanding achievements, completes assigned tasks ahead of schedule, completes unexpected tasks well, proposes or organizes innovation, creates positive changes, brings practical value and efficiency, the competent authority shall decide on the rate of excellent task completion in accordance with reality, ensuring the rights and legitimate interests of cadres, civil servants and public employees.
Store documents evaluating and classifying the quality of cadres, civil servants and public employees in electronic form.
According to Decree 48/3023/ND-CP, documents on the results of quality assessment and classification are kept in electronic form, including: Minutes of meetings for comments and evaluation; Forms for evaluating and classifying the quality of cadres, civil servants and public employees; Comments from the Party Committee at the workplace (if any); Conclusions and written notices on the results of the assessment and classification of the quality of cadres, civil servants and public employees by competent authorities; Records of handling recommendations on the results of the assessment and classification of the quality of cadres, civil servants and public employees (if any); Other relevant documents (if any).
The Decree clearly states that, in addition to being kept in electronic form, the Assessment and Classification Form for the Quality of Cadres, Civil Servants and Public Employees and the Conclusion and written notification of the results of the assessment and classification of the quality of Cadres, Civil Servants and Public Employees by the competent authority must also be kept in writing in the files of cadres, civil servants and public employees.
Decree 48/3023/ND-CP clearly states that, based on the regulations of the competent authority managing cadres, civil servants and public employees on quality assessment and classification, agencies, organizations and units employing cadres, civil servants and public employees shall promulgate assessment regulations suitable to the characteristics of their agencies, organizations and units.
The content of the Regulation must clearly define specific products associated with each job position, criteria for assessing quality, efficiency, and time of assessment by quarter, month or week (if any); basis for determining the percentage of work completion; component criteria for assessing and classifying the quality of cadres, civil servants and public employees, taking into account the ratio of the workload of cadres, civil servants and public employees compared to the total workload of the agency, organization or unit; encourage the application of information technology to assess and classify the quality of cadres, civil servants and public employees, ensuring compliance with the provisions of this Decree.
The assessment and classification of the quality of people working in key organizations shall comply with the provisions of the law on key organizations and shall not be contrary to the principles of assessment and classification of cadres of competent authorities.
