The Government issued Decree 48/2023/ND-CP dated July 17, 2023 amending and supplementing a number of articles of Decree 90/2020/ND-CP on assessment and classification of the quality of cadres, civil servants and public employees.

Supplementing principles for evaluating and classifying civil servants and public employees from September 15, 2023
Accordingly, Decree 48/2023/ND-CP added clauses 5 and 6 to Article 2 of Decree 90/2020/ND-CP on principles of assessment and classification of the quality of cadres, civil servants and public employees as follows:
- Cadres, civil servants and public employees subject to party or administrative discipline shall have their quality assessed and classified as follows:
+ Cadres, civil servants and public employees who are subject to party or administrative discipline in the year of assessment shall be classified as having not fulfilled their duties, except for the case specified in Point b, Clause 5, Article 2 of Decree 90/2020/ND-CP (amended in Decree 48/2023/ND-CP).
+ In case the violation has not yet been subject to a disciplinary decision by a competent authority but has been used as a basis for assessing and classifying the quality as not completing the task in the assessment year, the disciplinary decision issued after the assessment year for that violation (if any) shall not be counted for assessing and classifying the quality in the year of the disciplinary decision.
+ In case a cadre, civil servant or public employee is a party member and has been subject to party discipline and administrative discipline for the same violation but the party discipline decision and the administrative discipline decision are not effective in the same year of assessment, it will only be considered as a basis for quality classification in one year of assessment.
- The proportion of cadres, civil servants and public employees classified as "Excellently completing tasks" out of the total number of cadres, civil servants and public employees at the same agency, organization or unit and for each group of subjects with similar tasks must not exceed the proportion of Party members classified as "Excellently completing tasks" according to Party regulations.
In case an agency, organization or unit has outstanding achievements, completes assigned tasks ahead of schedule, completes unexpected tasks well, proposes or organizes innovation, creates positive changes, brings practical value and efficiency, the competent authority shall decide on the rate of excellent task completion in accordance with reality, ensuring the rights and legitimate interests of cadres, civil servants and public employees.
General criteria for evaluating and classifying the quality of cadres, civil servants and public employees
General criteria for evaluating and classifying the quality of cadres, civil servants and public employees according to Article 3 of Decree 90/2020/ND-CP are as follows:
- Comply with the Party's guidelines, policies, regulations, the State's policies and laws, and the Party's organizational and disciplinary principles, especially the principles of democratic centralism, self-criticism and criticism;
- Have a firm political stance and stance; be steadfast in your stance; do not waver in the face of any difficulties or challenges;
- Put the interests of the Party, nation, people, and collective above personal interests;
- Be conscious of researching, studying, and applying Marxism-Leninism, Ho Chi Minh thought, resolutions, directives, decisions, and documents of the Party.
* Ethics, lifestyle:
- No embezzlement, corruption, negativity, waste, bureaucracy, opportunism, profiteering, arrogance, or authoritarianism; no signs of moral or lifestyle degradation, self-evolution, or self-transformation;
- Have an honest, modest, sincere, pure, simple lifestyle;
- Have a spirit of solidarity, build clean and strong agencies, organizations and units;
- Do not let relatives or acquaintances take advantage of your position and authority for personal gain.
* Working style and manners:
- Responsible for work; dynamic, creative, dare to think, dare to do, flexible in performing tasks;
- Scientific, democratic and principled working methods;
- Have a sense of responsibility and coordination in performing tasks;
- Have proper attitude and behavior style, standard working manner, meeting the requirements of public service culture.
* Sense of organization and discipline:
- Comply with the organization's assignments;
- Implement the regulations, rules and regulations of the agency, organization and unit where you work;
- Declare and publicize assets and income according to regulations;
- Report fully and honestly, provide accurate and objective information on matters related to the performance of assigned duties and tasks and the activities of the agency, organization or unit to superiors when requested.
* Results of performing assigned duties and tasks:
- For officials, civil servants, leaders and managers:
+ Thoroughly grasp, institutionalize and implement the Party's guidelines and policies, the State's policies and laws at agencies, organizations and units;
+ Maintain discipline and order in agencies, organizations and units; do not allow disciplinary violations and violations of the law to be handled, and do not allow complaints and denunciations to continue; prevent and combat corruption and waste within agencies, organizations and units;
+ Lead, direct, organize inspections, supervision, and resolve complaints and denunciations according to authority; direct and implement administrative reform, reform of the public service and civil servant regime at agencies, organizations, and units;
+ Develop annual programs and action plans for the agencies, organizations and units assigned to manage and be in charge, clearly defining the results of implementing targets and tasks, quantifying them with specific products.
- For civil servants and public employees not holding leadership or management positions:
+ Results of performing tasks according to the provisions of law, according to the set plan or according to the specific assigned work; volume, progress, quality of performing tasks;
+ Attitude of serving people and businesses in positions that directly contact or directly handle the work of people and businesses.
