On the morning of February 7, the National Assembly Standing Committee gave opinions on a number of major issues regarding the reception, explanation, and revision of the draft Law on Teachers; including many provisions related to salary policies and retirement ages of teachers.

Salary increase for teachers needs to be calculated synchronously

Regarding the salary and benefits policy for teachers, Chairman of the Committee for Culture and Education Nguyen Dac Vinh said that some opinions agreed with the regulation of increasing 1 salary level in the administrative career salary scale system for teachers recruited and paid for the first time.

Some opinions are still hesitant, do not agree and suggest that it is necessary to evaluate the impact of this policy in general relation to the team of cadres, civil servants and public employees of the political system.

In response to the opinions of National Assembly deputies, the draft law was revised to remove the specific provision on increasing 1 salary level in the administrative career salary scale system for teachers recruited and receiving salary for the first time.

The auditing agency explained that teachers' salaries are ranked highest in the administrative career salary scale system; improving salary policies for civil servants and public employees needs to be studied and calculated synchronously in the process of building salary policies according to job positions.

Highly qualified teachers are allowed to voluntarily extend their working hours.

Regarding the early retirement policy for preschool teachers (Article 28), Mr. Nguyen Dac Vinh said that many opinions agreed with the policy of early retirement according to the law for preschool teachers. At the same time, he proposed to add the criterion that teachers must have paid social insurance for 20 years or more to be eligible for early retirement and not have their pension rate deducted.

However, there are also concerns about the resources to ensure the implementation of this policy and that the principle of contribution and benefit must be ensured according to the Law on Social Insurance.

According to the Standing Committee of the Culture and Education Committee, allowing preschool teachers to retire earlier than the age prescribed by law is a policy built on the characteristics of this group's professional activities and is suitable for the characteristics of preschool learners.

Therefore, this draft law has revised and supplemented the regulation that teachers in preschools, if they wish, can retire at an age lower than the retirement age of employees under normal conditions, but not more than 5 years, and the pension percentage will not be reduced due to early retirement if they have paid social insurance for 20 years or more.

Regarding the retirement regime at a higher age for teachers (Article 29), there are opinions suggesting specific regulations on requirements and conditions for teachers to extend their retirement age.

The review agency believes that it is necessary and reasonable to stipulate that teachers with high qualifications, academic titles, and degrees, and teachers working in specific specialized fields and sectors can have their working time extended and retire at a higher age.

This is to take advantage of and exploit high-quality human resources; to overcome the shortage of highly qualified teachers in a number of specific specialized fields and sectors that the country's development trend requires.

Therefore, the draft Law also clearly stipulates the conditions for implementing this policy when educational institutions have a need, teachers are healthy enough and voluntarily extend their working hours; at the same time, it adds the criterion of "meeting the standards and conditions of educational institutions".

During the period of extended retirement age, teachers in public educational institutions shall not hold leadership or management positions and shall not retain leadership or management position allowances.

The draft Law after being accepted and revised includes 9 chapters and 46 articles, 4 articles less than the draft submitted at the 8th session.

Delegating recruitment authority to the education sector is necessary

The Standing Committee of the Culture and Education Committee stated that it is necessary to assign recruitment authority to the education sector, both to ensure the authenticity of recruitment and to enhance responsibility and create conditions for the sector to be proactive in recruiting, using, managing and developing teachers, meeting the requirements on quantity, structure and quality; contributing to overcoming the situation of local surplus, shortage and imbalance in the structure of teachers.

This draft law is adjusted in the direction that, for public educational institutions that are given autonomy, the head of the educational institution carries out recruitment and is responsible for his or her decisions.

For public educational institutions that have not been granted autonomy, the competent authority managing the educational institution shall carry out the recruitment of teachers or decentralize the recruitment to the educational management agency or the head of the educational institution...

The above revision affirms the role and responsibility of the education management agency in advising; ensuring consistency with the provisions of the Law on Organization of Local Government, the Law on Civil Servants and the Labor Code, according to the head of the inspection agency.
