Finding solutions to remove obstacles in granting "pink books" to nearly 59,000 houses

On the afternoon of February 29, at the regular press conference of Ho Chi Minh City, Mr. Vo Cong Luc, Head of the Land Management Department, Department of Natural Resources and Environment of Ho Chi Minh City, said that in the first 2 months of this year, the Land Registration Office of Ho Chi Minh City signed certificates for 1,486 records.

At the same time, this office also received 1,189 new files in the past 2 months. Of these, the agency has issued tax transfer receipts for 825 files, while the rest are still being processed.

Regarding 81,000 units in commercial housing projects in Ho Chi Minh City that have been assessed as eligible for certificates but have encountered problems leading to the inability to complete the certification work, a representative of the Department of Natural Resources and Environment of Ho Chi Minh City said that about 22,147 certificates had been issued by the end of 2023. This number is higher than the plan of 22,000 records set out.

"In general, the issuance of certificates of land use rights, house ownership rights and other assets attached to land (pink books) for apartment buildings in the area is still in the process of resolving procedures for issuing certificates to investors implementing projects and then issuing pink books to each home buyer," said Mr. Luc.

Currently, there are 59,000 houses that have not been granted "pink books" out of 81,000 houses in commercial housing projects in the city that have been assessed as eligible, but there are problems leading to the inability to complete the work of granting land use right certificates.

Specifically, the Department of Natural Resources and Environment of Ho Chi Minh City identified 6 main groups of problems for these properties and proposed solutions and a roadmap to resolve them.

Regarding the causes, these 6 groups of problems include: Group waiting for tax; Group of projects late in submitting documents for granting certificates; Group of new real estate; Group of projects having to fulfill additional financial obligations; Group of projects with other problems; Group of projects under inspection and investigation.

The resolution of the above 6 groups of problems is carried out through solutions corresponding to each group of problems such as strengthening coordination with tax authorities to speed up the progress of determining tax obligations; urging investors and home buyers at the project to promptly submit documents to resolve procedures for granting certificates.

In addition, we will discuss and recommend the Ministry of Natural Resources and Environment to issue a document guiding the issuance of certificates for new real estate cases such as officetel and shophouse.

In addition, it is necessary to identify cases that must fulfill additional financial obligations and carry out specific land price determination as a basis for tax authorities to calculate additional financial obligations...

The Department also proposed to establish a Working Group of the Ho Chi Minh City People's Committee with the Standing Committee of the Ho Chi Minh City People's Committee as the head; the Department of Natural Resources and Environment, the Department of Construction as deputy heads, and other departments, the Public Security, and the Tax Department as members to resolve difficulties in the work of granting certificates for commercial housing projects in the area.
