On November 5, the National Assembly discussed in the hall the Draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army.
"Request permission to raise retirement age for generals to 60 years old"
One of the contents that many delegates are interested in and comment on is raising the retirement age for female general officers from 55 to 60 years old, and for men, keeping it at 60 years old as per current law.
Delegate Nguyen Dai Thang (Hung Yen delegation) agreed with raising the retirement age of military officers, in order to meet the requirements of the task of building a regular, elite, and modern revolutionary army.
According to Mr. Thang, it is necessary to promote and make use of the dedication of serving in the army with a team of officers who are well-trained, have courage, qualifications, experience, health and ensure policies for them when they retire according to the provisions of the Law on Social Insurance.
However, he was concerned that the draft law stipulates that the maximum age of military service for military officers is 60 years old. Therefore, it is necessary to study and consider increasing the age of military service for general officers to 62 to ensure the use of talents and the correlation between the two forces, the military and the police.
"The roadmap to increase the age of service in the army for police generals to 62 years old for men by 2028 is also consistent with the roadmap to increase the retirement age according to the current Labor Code, ensuring the consistency and unity of the legal system," said Mr. Thang.
Delegate To Van Tam (Kon Tum delegation) proposed extending the service age but not exceeding 62 for men and 60 for women.
The specific content should be assigned to the Government or the Minister of Defense to regulate. At that time, the Minister or the Government will specifically regulate how to increase and in which cases.
Explaining this content, Minister of Defense Phan Van Giang said that general officers can work longer, because in high positions, the work intensity with health is not required to be greater than that of lower levels.
However, according to Mr. Giang, the general retired at the age of 62, while the colonel retired at the age of 58, so the colonel cannot be promoted to the rank of general, while in the military there are many different levels and positions.
"Therefore, we would like to ask for permission to raise the retirement age for generals to 60 years old as per the draft law," said General Phan Van Giang.
He added that the army has many officers such as commanding officers, political officers, logistics officers, technical officers, etc.
"Our point of view is that we must feed the army for 3 years and use it for 1 hour, so in peacetime we must also train the army so that when a situation arises, we can handle it," General Phan Van Giang explained.
The Director of Public Security is a Major General, the Military Commander must also be a Major General, so "it's really difficult"
Another content that many delegates are interested in is the draft law proposing to increase the age limit for military officers of the rank of lieutenant and colonel to 1-4 years.
Specifically, for lieutenants, the maximum age limit for active officers (retirement age) increases from 46 to 50 years old; majors from 48 to 52; lieutenant colonels from 51 to 54; senior colonels from 54 to 56; colonels from 57 (for men) and 55 (for women) to 58 (regardless of gender).
Delegate Lu Van Hung (Bac Lieu delegation) proposed to study the military rank of the city's military commander. According to him, it is necessary to consider and study it appropriately when the police chief is a major general and the military commander is only a colonel, while both are members of the provincial Party Committee's Standing Committee.
Explaining the above issue, General Phan Van Giang, Minister of National Defense, said that if the regulation requires the police director to be a major general and the military commander to be a major general, "we find it difficult."
The Minister analyzed that the provincial police chief only has one major general, but the provincial military commander is related to the political commissar, and the provincial border commander is also related to the political commissar. These four positions are equal, but choosing only one to promote to general is "very difficult to balance."
Therefore, the Minister of Defense suggested that for this position, "we still recommend that it be colonel", because the tasks of the police and the army are different even though they are both armed forces in peacetime.
Proposal to increase military service age for lieutenant colonels, majors and lieutenant colonels
Voters proposed amending the Law on Officers of the Vietnam People's Army in the direction of increasing the age of service to be consistent with the provisions of the Law on Social Insurance on the number of years of social insurance contributions to receive pension.
