Many new points in the policy on early retirement

Kinhtedothi-According to the Ministry of Home Affairs, one goal of Decree 177/2024/ND-CP issued today (December 31) is to promptly develop appropriate policies to recognize the work process and contributions of cadres who are not old enough to be re-elected but wish to retire, contributing to improving the effectiveness and efficiency of cadre management.


This afternoon, December 31, at an extraordinary press conference organized by the Ministry of Home Affairs, Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs) Nguyen Tuan Ninh provided some notable information about the new points in Decree No. 177/2024/ND-CP, which was just issued by the Government today, stipulating the regime and policies for cases of non-re-election, reappointment and officials who resign or retire at will. The Decree takes effect from January 1, 2025.

According to the Director of the Department of Civil Servants and Public Employees, implementing the tasks assigned by the Government's Party Committee in Official Dispatch 2969-CV/BCSĐCP and the opinion of the Government's Permanent Deputy Prime Minister Nguyen Hoa Binh, the Ministry of Home Affairs has urgently drafted a Decree to replace Decree No. 26/2015/ND-CP following a simplified procedure to promptly issue policies to serve Party Congresses at all levels towards the 14th National Congress of the Party.

The objective of Decree No. 177/2024/ND-CP dated December 31, 2024 is to promptly institutionalize the Party's guidelines and policies on implementing regimes and policies for cadres after Party Congresses at all levels and cadres under the management of the Politburo and Secretariat who are allowed to retire or retire by competent authorities according to Conclusion Notice No. 20-TB/KL dated September 8, 2022 of the Politburo.

At the same time, develop appropriate policies to encourage and recognize the work process and contributions of cadres who are not old enough to be re-elected and wish to retire; resolve difficulties and inadequacies in the process of organizing and implementing policies, contributing to improving the effectiveness and efficiency of cadre management.

Notably, there are 3 groups of subjects entitled to the regime and policies in this Decree. One is the group that is not old enough to be re-elected (less than 30 months from the time of the congress to the time of retirement), including: cadres holding positions and specialized titles elected (Clause 1, Article 2); maintain the provisions as in Decree 26/2015/ND-CP, and at the same time add the provision that this subject includes cadres specified in this clause, applicable to both cases of cadres who are eligible for age to be re-elected to the Party Committee but are not old enough to be re-elected to leadership positions of the government, the Vietnam Fatherland Front, and socio-political organizations at the time of election, and congresses at the same level to elect those positions.

The addition of the regulation aims to resolve difficulties and problems from practice, whereby the congresses of agencies are held at different times, leading to cases where people are old enough to be re-elected at the agency or organization where they work but are not old enough to be re-elected to the Party Committee. Accordingly, this subject will also be subject to the regime of early retirement and termination of employment.

Officers and professional soldiers in agencies and units of the People's Army and the People's Public Security holding positions and titles in the structure of participating in the Party Committee, full-time members of the Inspection Committee at the same level (Clause 2, Article 2); supplemented to be subject to the application of the Decree to reform administrative procedures, relevant agencies do not have to issue documents guiding the implementation but can implement immediately when the Decree is issued, immediately resolving cases belonging to the armed forces.

Civil servants holding a fixed-term appointment position whose current position is part of the structure of participating in the Party Committee at the same level (Clause 3, Article 2). Supplemented to resolve practical difficulties, accordingly, there are a number of positions and titles in the state sector (civil servants) but are associated with the criteria and conditions of being old enough to be re-elected to the Party Committee.

Second , the group that is still old enough to be re-elected (from 30 months to 60 months): cases whose working time from the date of the Congress is from 30 months to 60 months are old enough to retire, but due to the arrangement of Party committee personnel, they wish to retire and are approved by competent authorities (Clause 4, Article 2); supplementing regulations according to the policy of the Politburo, accordingly, in cases of voluntary resignation or early retirement, there is a mechanism to motivate, encourage, and resolve early retirement.

Third , the group of cadres under the management of the Politburo and Secretariat

Cadres under the management of the Politburo and Secretariat are allowed to retire or retire by competent authorities according to Conclusion Notice No. 20-TB/KL dated September 8, 2022 of the Politburo (Clause 5, Article 2).

At the same time, supplement regulations according to the direction of the Politburo, creating a legal basis to resolve cases under the management of the Politburo and the Secretariat that have committed violations and are dismissed or retired early by competent authorities; supplement regulations allowing the application of the regime to cases that have not been disciplined but wish to resign or retire early.

At the same time, regulations on handling cases of resignation or retirement before the effective date of this Decree are issued to resolve problems with some cases of resignation or retirement in the recent past.

Regarding policies and regimes, the Director of the Department of Civil Servants and Public Employees informed that this Decree stipulates two specific policies, which are on early retirement and retirement waiting for retirement age.

In particular, the policy of continuing to work until retirement age is abolished to address the reality, accordingly, for many cases that are not old enough to be re-elected but still choose to stay on the job, it will be very difficult to arrange and assign work positions; encourage enjoying the regime to quit work and retire immediately.

The regimes and policies applied to those who are not old enough to be re-elected and retire early are higher than those in the current Decree according to the principle of being higher than the streamlining of the payroll. Specifically, the current salary is increased from 3 months on average to 5 months for the first 20 or 15 years of work with social insurance contributions; from the following year, they are entitled to 0.5 months of salary/year with social insurance contributions; the pension rate is not deducted for the period of early retirement; the average salary is increased from 3 months to 5 months for each year of early retirement.

According to Mr. Nguyen Tuan Ninh, during the process of developing this Decree, units within the Ministry of Home Affairs have closely coordinated to ensure the policies and regimes issued by the Government in the context of focusing on restructuring and streamlining the apparatus in the political system. Therefore, the Decree stipulates that "in case the subjects specified in Article 2 of this Decree are also subject to policies and regimes in the implementation of restructuring the apparatus, they can choose to enjoy higher policies and regimes" in Clause 4, Article 7.
