On the afternoon of November 3, the XV National Assembly delegates continued to discuss in the hall the draft Land Law (amended), in which the content of the land recovery plan for socio-economic development received much attention.

National Assembly Delegate Pham Van Hoa (Dong Thap Delegation) said that regarding commercial housing projects, mixed housing, business, trade and service projects, this is very important content, expected by voters, especially people whose land is being recovered for projects with land rent differences.

" There should be specific criteria and conditions for the State to reclaim land and hand it over to investors, to avoid affecting the rights, activities and lives of the people, " said Mr. Hoa.

According to the delegate, for projects of hundreds of hectares or more, if investors negotiate with each resident, it will be very difficult to achieve 100% consensus. Therefore, it is necessary to have methods and principles for land valuation that are suitable for reality, harmonizing the interests of investors and residents.

Sharing the same view, delegate Trinh Xuan An (full-time member of the National Defense and Security Committee) said that Resolution 18 stated "continuing the agreement mechanism in land recovery", but did not require all projects to have agreements.

Mr. An said that land recovery for socio-economic development aims to promote land resources, improve land efficiency, and develop socio-economic infrastructure.

" The most important thing is to promote land resources and turn land into the strength of the economy. To do so, it is necessary to allow reclamation for projects. Of course, the scale and nature of the reclamation should be stipulated directly in the law ," according to delegate Trinh Xuan An.

He suggested that land acquisition could be applied to large-scale projects of 300 hectares or more and that they are modern urban and residential areas. Only then would the criteria be met, and the country would have the face of a large urban area, with large works and projects.

"We have to recover to do it, but if we negotiate, when we cannot negotiate, the regulations become meaningless. We cannot have a project with an area of ​​hundreds of hectares where we negotiate with each household and each person," Mr. An said, emphasizing the principle that the interests of the people and businesses must be in harmony in this story.

This morning, National Assembly delegate Tran Van Lam (Bac Giang delegation) said that the State should take the initiative to reclaim land to create favorable conditions, however, Resolution 18 stated the Party's viewpoint that the principle of agreement in land reclamation must be followed.

Raising the issue of when to negotiate and how to negotiate, he assessed that the principle of negotiation ensuring market principles is very correct, very reasonable and must be followed. However, it is necessary to distinguish between land recovered for commercial housing projects. If it is residential land, both parties must negotiate. If it is agricultural land, it is not residential land yet. The issue of converting it to residential land is the authority of the state.

Thus, only the State can take over, then transfer the rights and transfer them to a commercial housing project, then conducting an auction will be reasonable.

But with agricultural land transferred to agricultural production projects of enterprises, according to Mr. Lam, now it is necessary to return to the agreement.

This revised Land Law stipulates that the State will reclaim land to implement socio-economic development projects for national and public interests, such as construction of traffic works; irrigation works; water supply and drainage works; solid waste treatment works; energy works, public lighting; oil and gas works; postal, telecommunications, information technology infrastructure; traditional markets, wholesale markets; religious and belief works; public entertainment areas.

The draft revised Land Law has been commented on by the National Assembly at its 4th and 5th sessions. The National Assembly will vote and pass the draft law on the morning of November 29, the last day of the 6th session of the 15th National Assembly.
