On the morning of January 14, speaking with VietNamNet reporter, Mr. Nguyen Van Chat, Chairman of the Inspection Committee of Mang Yang District Party Committee (Gia Lai province) said that the District Party Committee has issued a disciplinary decision in the form of a reprimand against Mr. Nguyen Van Ha, Deputy Secretary of the Party Committee, Chairman of the People's Committee of Dak Ya commune.
According to Mr. Nguyen Van Chat, in terms of personal position and role, Mr. Nguyen Van Ha is the Chairman of the Commune People's Committee. Furthermore, this land plot is under Mr. Ha's name, has not been converted to a new use purpose, and is leased in violation of the law.
"Previously, the Standing Committee of the District Party Committee inspected according to Article 30 of the Party Charter, discovered signs of violations, then transferred them to the Inspection Committee for consideration and handling," informed Mang Yang, Head of the District Party Committee's Inspection Committee.
Mr. Nguyen Van Ha's shortcomings and violations have negatively affected his own reputation and that of the Party organization and the agency he works for; violated regulations on "things that Party members are not allowed to do"; lacked responsibility in complying with the provisions of the law on land and housing; and in managing violations of the law on land, causing negative public opinion.
After reviewing the content, nature, level and cause of the violation, the Mang Yang District Party Committee's Inspection Committee met to analyze, evaluate and vote to discipline Mr. Nguyen Van Ha, Deputy Secretary of the Party Committee and Chairman of the People's Committee of Dak Ya commune, with a reprimand.
As VietNamNet reported, although he clearly knew that land plot No. 00, map sheet No. 00 (Chau Son village, Dak Ya commune) was granted a certificate of land use rights, house ownership rights and assets attached to land No. BD 491671, an area of 19,375 m2 of his family as agricultural land (land for growing perennial crops), Mr. Nguyen Van Ha still agreed to let Mr. Phan Duc Truong (born in 1984, residing in Thua Thien Hue province, the person who rented the land from Mr. Ha) rent it to 3T Education Development and Vocational Training Company Limited (the managing unit of 3T Gia Lai Vocational Education Center) and build some items as a driving practice ground.
After leasing the land, the lessee illegally built items such as waiting rooms, parking lots, driving practice grounds, and toilets on agricultural land, but the Chairman of the Dak Ya Commune People's Committee did not regularly inspect and promptly prevent it. Only when the construction of the above items was almost completed did it report and only when there was direction from superiors did it conduct inspections and impose administrative penalties.
Mr. Nguyen Van Ha, Chairman of Dak Ya Commune People's Committee, was still not determined in directing the implementation of measures to overcome the consequences and restore the original state. Therefore, the illegal construction still exists until today.
Due to improper use of leased land and improper driver training content and program as prescribed, Gia Lai 3T Vocational Education Center was administratively fined 12.5 million VND by the Gia Lai Department of Transport Inspectorate and suspended enrollment for 3 months, from December 26, 2023 to March 24, 2024.
On January 3, the Gia Lai Provincial People's Committee issued a document assigning the Department of Transport to preside over and coordinate with Mang Yang district and related departments, branches and units to organize an inspection and clarify the information that Gia Lai 3T Vocational Education Center used nearly 2 hectares of agricultural land in Chau Son village, Dak Ya commune (Mang Yang district) to serve as a driver training facility as reported by VietnamNet Newspaper.
Gia Lai Provincial People's Committee also assigned the Department of Transport of this province to urgently clarify the above information to respond to VietNamNet Newspaper and report the results to the Provincial People's Committee.
