Latest conditions for land subdivision and separation in Bac Ninh province

(Dan Tri) - According to new regulations of Bac Ninh province, for residential land without approved detailed planning, the minimum area after land division must be from 40m2 or more, with each side not less than 3.5m.


Recently, the People's Committee of Bac Ninh province issued Decision 32/2024 detailing and guiding the implementation of a number of articles of the Land Law and Decree No. 102/2024 of the Government in the province, including regulations on land plot separation and consolidation.

For urban residential land, rural residential land along national highways, provincial roads and in new urban planning areas, the minimum residential land area after subdivision is implemented according to the approved detailed planning. In addition, in cases where there is no approved detailed planning, the minimum area after subdivision must be from 40m2 or more and each side must not be less than 3.5m.

For rural land not covered by the above provisions, the minimum land area after subdivision shall be implemented according to the approved detailed planning. In the absence of an approved detailed planning, the minimum area after subdivision shall be from 70m2 or more and each side shall not be less than 4m.

In addition, the subdivision of residential land with gardens and ponds is determined according to the regulations on subdivision of residential land, not applying the regulations on the minimum area of ​​agricultural land allowed for subdivision.

For land plots with existing housing built before April 18, 2008, and housing projects that have been granted a Construction Permit or permitted to exist by a competent state agency, the plots can be divided according to the current housing status.

For agricultural land, households and individuals who are allocated land by the State and have their land use rights recognized for stable agricultural production purposes and have the need to separate the plot to exercise their rights according to regulations, the area of ​​the new plot of land and the remaining area of ​​the plot of land after separation must be at least 360 square meters.

In case of land division to divide or separate the population, the permanent residence or the laborers who have been assigned or recognized the right to use agricultural land, the area of ​​the newly divided land plot and the remaining area of ​​the land plot after division must have a minimum area equal to the area assigned or recognized for one population or permanent residence.

For non-agricultural land but not residential land, households and individuals using land leased or allocated by the State with land use fees collected for production and business facilities when dividing the plot, the minimum area is the area according to the production and business project and according to the planning or detailed planning adjustment approved by the competent state agency.

In case there is no detailed planning, the minimum area after land division is not less than 3,000m2.

Previously, a series of provinces and cities such as Bac Giang, Lam Dong, Hanoi, Da Nang,... also issued new regulations on land division.
