Evaluation of the implementation of Resolution 18, as a basis for amending the 2024 Land Law

On the morning of July 10, Politburo member, Secretary of the Government Party Committee, Prime Minister Pham Minh Chinh chaired the Conference to review 3 years of implementing Resolution No. 18-NQ/TW (Resolution 18) and 1 year of implementing the Land Law 2024, proposing adjustments and supplements to a number of contents of Resolution 18, as a basis for amending the Land Law 2024.

In his opening speech, Prime Minister Pham Minh Chinh stated that land-related legal policies have a comprehensive and all-encompassing impact on the entire population. After 3 years of implementing Resolution No. 18 and 1 year of implementing the 2024 Land Law, land-related legal policies have been implemented synchronously and achieved positive results.

According to the Prime Minister, land policies and laws have gradually come into effect, overcoming difficulties and obstacles, improving the effectiveness of state management, contributing to socio-economic development, ensuring national defense, security and sustainable development of the country; and strengthening the trust of people, businesses and investors.

In addition to the achieved results, the Prime Minister frankly pointed out that land policies and laws still have some limitations and shortcomings, are not suitable with the policy of reorganizing two-level local governments, and do not fully meet the development requirements of the country in the new period.

According to the Government leader, the land recovery policy still distinguishes between projects using public investment capital and projects using private investment capital; procedures for land recovery, compensation, support, resettlement, land allocation, land lease, and land use conversion are still lengthy.

In addition, some innovative policies on land finance in the spirit of Resolution No. 18 have not been fully institutionalized; the role of the State in deciding and controlling land prices as the representative of land owners has not been clearly defined. In addition, the situation of taking advantage of land auctions to speculate, inflate prices, and manipulate prices to disrupt the market still occurs in many places...

The Head of Government also pointed out a number of causes for the above limitations. Among them, the awareness of the role and importance of land in a socialist-oriented market economy and the role of the State as the representative of the owner and the unified state management of land is still inadequate and inconsistent.

Along with that, legal regulations related to land are still inconsistent, inconsistent, and frequently adjusted and supplemented; investment, planning research, reasonable allocation, and removal of difficulties and obstacles to unblock land resources to serve the country's socio-economic development are sometimes not given adequate attention...

In response to practical requirements as well as implementing the direction of competent authorities, the Government Party Committee chaired the assessment of 3 years of implementing Resolution No. 18, 1 year of implementing the Land Law 2024, on that basis, proposed to adjust and supplement Resolution No. 18, as a basis for amending and supplementing the Land Law 2024.

According to the Prime Minister, this is a very important and urgent task that must be carried out in a short time but must ensure quality requirements to remove obstacles and have a mechanism to further promote resources from land, and soon submit it to the Central Executive Committee for comments.

At the meeting, the Prime Minister requested delegates to frankly assess the situation and results of the implementation of Resolution No. 18 and the 2024 Land Law, especially objectively reflecting issues arising from real life, especially issues related to planning, land use plans, land allocation, land lease, land recovery, compensation, resettlement; land recovery for socio-economic development for national and public interests; adjusting and supplementing solutions on land price determination; land issues involving foreign elements...

Resolution No. 18 on "Continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a high-income developed country" was issued by the 13th Central Executive Committee on June 16, 2022.

On the basis of institutionalizing the Party's viewpoints and policies and the content of Resolution No. 18, the 2024 Land Law was passed by the 15th National Assembly on January 18, 2024, replacing the 2013 Land Law and taking effect from August 1, 2024.
