According to the program, on the afternoon of November 24, the National Assembly will discuss the draft Law on Road Traffic Order and Safety in the hall. The report summarizes the opinions of National Assembly deputies at the previous group discussion session, suggesting that the drafting agency study whether it is necessary to change driver's licenses issued before 2012. The current fee is 135,000 VND, changing driver's licenses will be costly.
Explaining this issue, on behalf of the drafting agency, General To Lam, Minister of Public Security, said that changing the unlimited driving license from paper to PET plastic (from paper card to plastic card) issued before July 1, 2012 is necessary.
The Minister also affirmed that this is in accordance with and strictly implements the policies of the Party, the State and the direction of the Government, and current legal regulations on digital transformation, data synchronization, identification, electronic authentication, serving State management work, serving people to conduct transactions in the electronic environment.
The Minister cited Decree 59/2022 of the Government on electronic identification and authentication, stating that many types of documents have information synchronized into the electronic identification account, of which the driver's license is a basic type of document.
For unlimited driving licenses issued before July 1, 2012, some basic information fields such as date of birth, month of birth, ID card number, citizen identification number... are still missing, so they cannot be synchronized to the electronic identification account, ID card. On the other hand, paper driving licenses issued before July 1, 2012, used for more than 10 years, are old, wrinkled, and worn. Therefore, it is necessary to convert to a new plastic card driving license that can fully integrate the required information fields.
However, the Minister of Public Security also acknowledged that the conversion from paper to plastic driving licenses will incur financial and time costs for the people. Therefore, to limit the pressure of conversion and create more convenience for the people, the Government will implement the conversion in a roadmap, study the cost level, and implementation measures to ensure the most convenience for the people.
According to the Vietnam Road Administration, the country currently has about 22 million unlimited paper motorcycle driving licenses (types A1, A2 and A3) issued from 1995 to July 2012. If the draft law is passed, users of these driving licenses will have to complete procedures to change to PET cards.
According to the draft law, motor vehicles and specialized motorbikes participating in traffic must have a journey monitoring device, a device to collect data and images of the driver, and data and images to ensure journey safety according to regulations. National Assembly deputies said that the above regulation needs to be studied and calculated to see if it violates privacy or not?
Delegates also suggested studying, calculating, and considering the application of the above regulations to business vehicles, contract vehicles, and service vehicles to ensure suitability and avoid waste. For personal vehicles, installation is only encouraged, not required.
Regarding this issue, General To Lam said that the draft law is being reviewed and commented on by the National Assembly and is expected to be approved at the 7th session (2024). During this process, the drafting agency will closely coordinate with the National Assembly's review agency and relevant agencies and units to study, absorb, and explain the opinions of National Assembly deputies to revise and complete the draft law to ensure thoroughness, quality, and feasibility.
In particular, it will carefully study to adjust regulations on journey monitoring devices, data collection devices, driver images, data, images to ensure journey safety in accordance with the type of vehicles participating in road traffic as well as the actual conditions in Vietnam today. At the same time, it will ensure the privacy of individuals and the feasibility of the provisions of the law when applied in practice.
