Politburo regulations on handling complaints against officials under the Central management

According to the new decision of the Politburo, the complaint handling process includes 3 steps: preparation, implementation and conclusion.

Accordingly, in the first step, the Central Inspection Commission (or the advisory and support agency of the Politburo and the Secretariat assigned by the Standing Secretariat) works with the whistleblower to clearly identify the identity and address of the whistleblower; the party organization, party member being denounced and the content of the denunciation; advises on the establishment of a denunciation settlement team (inspection team) and a plan to resolve the denunciation.

The Politburo and the Secretariat shall issue a decision to establish a delegation and a plan to handle complaints. Based on the nature and content of the complaints, they shall decide on the head of the delegation, composition, and number of members of the inspection delegation as appropriate.

The plan for handling complaints must clearly define the purpose, requirements, content, subjects, timeline, methods, implementation time...

If the accused party organization or party member is found to have other signs of violations, the head of the delegation shall report to the Politburo and the Secretariat for consideration and decide to assign the Central Inspection Commission to inspect when there are signs of violations.

The time limit for handling complaints shall not exceed 180 days from the date of issuance of the decision to establish the inspection team. If necessary, a decision may be made to extend the time limit for handling complaints, but not more than 60 days.

The inspection team studies the complaint, develops an outline to request the accused party organization and party member to report and explain; plans the inspection team's work schedule, operating regulations, assigns tasks to each member of the inspection team; prepares relevant documents and materials.

The Party Central Office ensures funding and necessary conditions for the inspection team to carry out its tasks.

Dual process with voluntary disciplinary action

In the next step, the inspection team or the inspection team representative will implement the decision and plan to resolve the complaint, agree on a working schedule with the party organization, the accused party member and the representative of the party organization managing the party member; request the party organization and the accused party member to prepare a report according to the outline, provide records and documents; and direct relevant organizations and individuals to coordinate implementation.

The accused party organization and party member shall prepare a written report and related records and documents to send to the Politburo and the Secretariat (through the inspection team).

The inspection team studies the reports, records, documents and evidence received; conducts examination, verification and works with the accuser, organizations and individuals related to the content of the accusation and the accused party organization and party member.

During the investigation and verification process, the inspection team will meet and work directly with the whistleblower (if necessary) to re-determine, explain, supplement and clarify the content of the denunciation; guide the whistleblower to exercise his/her rights and obligations; and implement measures to protect the whistleblower according to regulations.

When it is necessary to adjust or supplement the content, processing time, requirements for assessment, appraisal, and professional and technical expertise of competent agencies as a basis for concluding the content of the denunciation, the inspection team shall report to the Politburo and the Secretariat for consideration and decision.

The inspection team drafts a report on the results of handling the denunciation. In cases where the violation is clear and requires disciplinary action, and the party organization or party member being denounced voluntarily reviews and accepts a disciplinary measure commensurate with the violation, the head of the inspection team reports to the Standing Secretariat to combine the disciplinary procedure with the denunciation handling procedure (implementing a dual procedure).

While conducting inspection and verification, if the accused party organization or party member is found to have other signs of violations, the head of the delegation shall report to the Politburo and the Secretariat for consideration and decision to transfer to inspection when there are signs of violations or assign the Central Inspection Commission to inspect when there are signs of violations.

At the same time, include the conclusion of the denunciation content in the inspection results report when there are signs of violations for consideration and general conclusion; at the same time, prepare a file to complete the denunciation settlement.

Then, hold a conference to approve the report on the results of handling the complaint.

At the conference, the inspection team approved the report on the results of handling the denunciation; the party organization and party member being denounced presented their opinions and explanations, and self-accepted the disciplinary measure (if any); the conference discussed and gave opinions; and voted to propose the disciplinary measure (if any).

The inspection team continues to examine and verify unclear contents or those with different opinions; completes the draft report on the results of handling the complaint.

The inspection team coordinates with the Party Central Committee Office to report to the Standing Secretariat to decide on the time and composition of the Politburo and Secretariat meetings; send reports on handling denunciations and files and documents to Politburo members and Secretariat members according to working regulations.

At the end of the complaint handling step, the Politburo and Secretariat conference will review and conclude (if it is under the jurisdiction of the Party Central Committee, the inspection team will report to the Politburo for direction before submitting it to the Party Central Committee).

At the conference, the inspection team reported the results of handling the denunciation; fully presented the opinions of the party organization, the accused party member and the denouncer, and related party organizations and party members.

The conference discusses, concludes; votes to decide on disciplinary measures or proposes to competent authorities to discipline violating party organizations and party members (if implementing the dual process).

The inspection team completes the notice of conclusion on handling the complaint, disciplinary decision or report to propose competent authority to enforce discipline to submit to the Standing Secretariat for signing and promulgation.
