Kinhtedothi - On October 31, the Standing Committee Member of the City Party Committee, Permanent Vice Chairman of the Hanoi People's Council periodically received citizens in October 2024 regarding the case according to the petition of Mr. Nguyen Quang Sang and Mr. Duong Ngoc Tien (in Thanh Tri ward, Hoang Mai district).
Accordingly, Mr. Nguyen Quang Sang (in group 1, Thanh Tri ward, Hoang Mai district) and Mr. Duong Ngoc Tien (in group 4, Thanh Tri ward, Hoang Mai district) submitted a petition requesting direction to resolve the issue of land allocation for resettlement for 119 households in Dam Dao area, Thanh Tri ward, Hoang Mai district.
The incident unfolded as follows: On July 3, 2003, the City People's Committee issued Decision No. 3833/QD-UB on granting 9,560 square meters of land to implement the project of allocating land for resettlement to 119 households for housing in Dam Dao area, Thanh Tri commune, Thanh Tri district - now Thanh Tri ward, Hoang Mai district.
On December 29, 2003, households paid land use fees according to receipt number N9 004110 of the City Tax Department.
On June 30, 2006, the City People's Committee issued Document No. 915/VP-NNĐC assigning the Department of Natural Resources and Environment to advise the City People's Committee on difficulties and obstacles in implementing land allocation for resettlement of 119 households in Dam Dao area.
On August 2, 2006, the Department of Natural Resources and Environment issued Document No. 2910/TNMT&ND-KH reporting to the City People's Committee that the allocation of land for resettlement to households in suburban communes (now inner city) must still ensure the principle of synchronous infrastructure construction and compliance with urban development planning;
At the same time, the Department of Natural Resources and Environment requested the People's Committee of Hoang Mai District to direct the Ward People's Committee to agree with the households to sign a contract with a legal entity to build houses for sale (or possibly designated by the District People's Committee) as the project investor, to organize the synchronous construction of technical infrastructure of the land and house foundation of each household according to the approved planning. Then hand over the house foundation directly to the households to build their own houses according to the granted construction permit.
On November 3, 2014, the Department of Natural Resources and Environment coordinated with relevant units to hand over the land boundary markers to the People's Committee of Thanh Tri Ward with a total area of 8,328m2 of land (reduced compared to before due to retaining the pond and well of the communal house located in the Dam Dao resettlement land).
During the process of handling petitions, the City People's Committee Office has repeatedly issued documents to guide and urge the Hoang Mai District People's Committee to remove obstacles and resolve petitions from households. However, to date, the petitions of citizens have not been completely resolved.
At the citizen reception, after listening to the units report on the progress of handling the petition, Permanent Vice Chairwoman of the City People's Council Phung Thi Hong Ha emphasized that the case has lasted for 20 years, and policies on land and construction investment have also changed a lot. Although the City People's Committee has issued many directive documents, the Department of Natural Resources and Environment, the Department of Planning and Investment, etc. have also issued many advisory and guidance documents. However, according to the report of the Hoang Mai District People's Committee, the implementation according to the instructions of the departments and branches has encountered difficulties in handling the incidents that have occurred.
These problems stem from the fact that Thanh Tri Ward People's Committee and Hoang Mai District units did not fully implement the regulations at the previous time; State policies change over time.
To resolve the case once and for all, the Standing Vice Chairman requested the City People's Committee to direct the Hoang Mai District People's Committee, the Department of Natural Resources and Environment, the Department of Planning and Investment, the Department of Finance, the City Inspectorate and specialized agencies to review all legal regulations on land and investment over the periods. Clearly identify methods and approaches to resolve the case once and for all in accordance with the provisions of the Law and ensure the rights of the people.
The Standing Vice Chairman of the City People's Council assigned the People's Council's Legal Committee, the Office of the National Assembly Delegation and the City People's Council, and the City Citizen Reception Committee to monitor, urge and supervise the settlement, synthesize and report to the Standing Committee of the City People's Council according to regulations.
