Current status of illegal construction
Recorded at the apartment complex of Muong Thanh Hotel Complex and Son Tra luxury apartment project, on floors 2, 3, 5, 35, illegal construction items have been dismantled.
The 4th, 41st and 42nd floors are still intact and have many residents living there.
According to Mr. Nguyen Van Thanh - representative of residents, the investor has just removed the violations on some floors but has not yet restored the function according to regulations.
In addition, illegal construction items on other floors have not yet been handled.
"We request that the investor correct the violations, restore the function and promptly carry out the procedures for project acceptance to issue pink books and hand over to the people," said Mr. Thanh.
After receiving the petition from residents, the People's Committee of Ngu Hanh Son District (Da Nang) assigned relevant units to establish an inspection team at the project, and at the same time requested the investor to promptly remedy the shortcomings.
Sources from the authorities confirmed that the investor has proposed to allow the items on floors 4, 41, and 42 to remain, after dismantling and carrying out steps to restore the functions of the other violating floors.
However, the competent authority has not yet considered and made a decision, because this issue must ensure many conditions according to regulations, such as whether it is consistent with the planning, the criteria or not...

Persistent violations
According to investigation, in 2016, authorities discovered that the investor arbitrarily changed the function, turning 4 floors into 104 apartments in the apartment building of the above project.
After that, the local authorities implemented a plan to enforce and dismantle illegal construction items in the apartment building from the 2nd to the 5th floors.
However, the enforcement plan had to be postponed. The reason was that in 2018, the district continued to discover other violations at this Muong Thanh project. For example, on the 35th floor, according to the construction permit, at the DH axis intersecting with the 2-8 axis is a shelter room, but the investor has built 8 rooms, completed and put into use.
On the 41st floor, according to the construction permit, the construction area is 313m², but in reality, the investor has expanded this entire area with a construction area of 4,393m² and arranged 26 rooms, the construction has been completed and put into use...

Muong Thanh's violation handling process has dragged on for many years.
The authorities continue to deploy enforcement. However, due to the impact of the COVID-19 epidemic, this has been delayed.
Next, the investor voluntarily demolished about 78 illegal apartments on floors 2, 3, and 5 (previously, according to the design, these floors were used as parking lots and kindergartens).
