7th Session of the 15th National Assembly Provincial National Assembly Deputies discuss in Groups the Draft Law on Notarization Amendment

Continuing the 7th Session of the 15th National Assembly, on the afternoon of June 17, the National Assembly discussed in Groups: Draft Law on Notarization (amended); Draft Law on Value Added Tax (amended); Draft Resolution of the National Assembly on reducing value added tax. The delegation of National Assembly deputies of Ninh Binh province participated in the discussion in Group 12 with the delegations of National Assembly deputies of the provinces: Quang Binh, Hung Yen, Ninh Thuan.

Participating in giving comments on the Draft Law on Notarization (amended), delegate Tran Thi Hong Thanh, Deputy Head of the National Assembly Delegation of Ninh Binh province, highly agreed on the necessity of amending the Law to overcome institutional limitations and shortcomings, creating a legal basis for a new development step of notarization activities.

Highly agreeing with the Review Report, delegates requested the drafting agency of the Law Project to thoroughly study the report to complete the Law Project.

Giving specific comments on the regulations on notarization of translations, delegates agreed with the amendments stipulated in the draft Law.

Accordingly, notaries are allowed to authenticate translators' signatures according to the provisions of the Authentication Law.

Delegates also suggested that there should be a separate regulation on electronic notarization in an unlimited scope, in order to meet current practical requirements, contribute to promoting digital transformation in notarization activities, and ensure consistency with the new regulations of the Law on Electronic Transactions in 2023.

However, the delegate also noted that in practice, there may be factors when performing electronic notarization that cannot completely replace humans, such as determining whether the notarization participant has sufficient civil capacity to participate in the transaction or not.

On the other hand, the notary ensures the accuracy of the notarized documents. If electronic notarization is performed online, it will pose a risk to the notary; checking with the documents will also be difficult.

Therefore, it is proposed that the draft Law should have provisions assigning the Government to prescribe a roadmap for implementing electronic notarization online, ensuring feasibility.

In addition, delegates also gave specific comments on: regulations on the legal value of notarized documents; standards for appointing notaries; State management of notarization; and the organizational model of Notary Offices.

Previously, in the morning session, delegates discussed in the hall about: "Investment policy for the North-South Expressway construction investment project in the West, Gia Nghia (Dak Nong) - Chon Thanh (Binh Phuoc) section"; about adjusting the investment policy of the National Target Program on socio-economic development in ethnic minority and mountainous areas for the period 2021 - 2030.

Also in the morning session of June 17, the National Assembly voted to approve the adjustment of the second phase of the 7th Session of the 15th National Assembly. Accordingly, in terms of time, this second phase will take place from June 17 to the morning of June 29; extending one day compared to the scheduled program at the beginning of the session.

The meeting agenda added three more contents related to the law on real estate and housing; a resolution on reducing value-added tax and deciding on contents under its authority.
