Hanoi increases minimum land area for subdivision to 50m2

According to Decision 61/2024/QD-UBND of Hanoi City People's Committee, on land division, in wards and towns, land plots must have a length and width of 4m or more, with a minimum area of 50m².

It stipulates the conditions and minimum area for land division and land consolidation (implementing Clause 4, Article 220 of the Land Law).

1. Conditions for land division for residential land (the entire area of the land is residential land):

a) The subject of land division must ensure the conditions according to Point b, Clause 1 of this Article, except for the following cases:

+ Land plots belonging to the project as prescribed in points a, b, c, d and e, Clause 1, Article 31 of the 2023 Housing Law;

+ The land plot is in an area with a detailed 1/500 scale plan for each land plot approved by a competent authority;

+ Land plots attached to state-owned villas that have been sold or privatized but are on the list of villas to be preserved and restored according to the Regulations on management and use of old villas built before 1954 in the City approved by the City People's Committee;

+ Land plots in relic protection areas shall comply with the provisions of the Law on Cultural Heritage.

b) The subdivision of residential land plots must ensure the principles and conditions prescribed in Article 220 of the 2024 Land Law and the following conditions:

2. Conditions for land division for non- agricultural land (not residential land):

For non-agricultural land, the regulation applies to land plots that are not allocated or leased by the State for project implementation. In wards and towns, commercial service land that wants to be divided must have a width adjacent to a traffic road of 10m or more, with a minimum area of 400m2.

In case of other non-agricultural land, the plot of land must be over 20m wide and have a minimum area of 1,000m2.

In communes, commercial service land must have an area of not less than 800m2 and other non-agricultural land must have an area of not less than 2,000m2.

Also according to the city's regulations, for agricultural land, the minimum area for land for annual crops is 300m2 in wards and towns and 500m2 in communes; land for perennial crops and aquaculture land is 500m2 in wards and towns and 1,000m2 in communes, respectively.

Production forest land can be divided into plots if the area is not less than 5,000m2.
