According to the Ministry of Education and Training , in the face of the current difficulties and problems of localities in the field of educational management when implementing two-level local government such as: the management team at the Department of Culture and Society lacks expertise and experience leading to confusion and difficulties, the Ministry of Education and Training requests the Provincial People's Committee to consider and implement one or several solutions to resolve the problem.
Mobilizing retired cadres to participate in consulting
The Ministry of Education and Training requested the provincial People's Committee to reasonably allocate civil servant staff at the provincial and communal levels to ensure sufficient quantity and quality, and at the same time direct the communal People's Committee to review the communal civil servant staff currently working at the Department of Culture and Social Affairs to ensure the right people are assigned.
Specifically, mobilize civil servants who have previously worked at the Department of Education and Training or receive and second educational managers and teachers at all levels with appropriate expertise and experience to arrange them into positions in charge of education and training at the commune level if they meet the prescribed conditions.

Establish under the authority of the Commune-level Education Advisory Council; groups/teams of key educational institution managers to advise and support the implementation of educational and training activities at the commune level. Participants are educational managers, teachers who are working or retired, ensuring that there are no problems arising in the unit or administrative organization.
Assign the Department of Education and Training to recruit and mobilize teachers
The Ministry of Education and Training has also requested the Provincial People's Committee and the Chairman of the Provincial People's Committee to consider and decide on decentralization, authorization, and assignment to the Department of Education and Training to preside over the recruitment, reception, mobilization, secondment, and transfer of teachers and staff in educational institutions in the province.
Pursuant to Clause 10, Article 23 of the Law on Organization of Local Government, the duties and powers of the Chairman of the Commune People's Committee are "To direct and organize the recruitment, use and management of civil servants and public employees in the area in accordance with the provisions of law and decentralization of superior state agencies". Thus, the Chairman of the Commune People's Committee shall only perform the recruitment and use of civil servants if decentralized.
“In the context that the number of commune-level civil servants in charge of education and training is currently lacking, and many people do not have experience in state management of education, decentralization to the Department of Education and Training to take charge of recruiting, receiving, mobilizing, seconding, and transferring teachers and staff in educational institutions in the province is appropriate to the current conditions and capacity of the Department of Education and Training,” the Ministry of Education and Training affirmed.
In addition, assigning the Department of Education and Training to take the lead in recruiting, receiving, mobilizing, seconding, and transferring teachers and staff ensures the implementation of the policy of reducing intermediaries, synchronizing recruitment quality (one-time recruitment can be registered for admission to many schools based on exam/review results), saving costs, and increasing opportunities for recruitment participants. At the same time, it contributes to overcoming the local surplus/shortage of teachers and staff as well as ensuring the structure of the team according to grade level, subject, and educational activities.
