Circular 45/2024 regulating the issuance, re-issuance, temporary suspension, and revocation of road vehicle inspection certificates has many important amendments, solving the current shortage of inspection staff.
No revocation of suspended vehicle inspector certificates before January 1, 2026
At the Conference on disseminating legal documents implementing the Law on Road Traffic Order and Safety organized by the Vietnam Register on the evening of December 18, Mr. Nguyen Duc Nghia, Deputy Head of the Personnel Organization Department - Vietnam Register, said that Circular 45/2024 clearly stipulates that inspectors will have their certificates temporarily suspended for 30 days if: They falsify certification and inspection results;
Having acts of harassment, causing difficulties and troubles for organizations and individuals in the process of performing tasks; Not performing assigned tasks without a valid reason; Violating regulations on labor discipline; internal rules and working regulations of agencies and units.
According to Circular 45/2024, inspectors who are sentenced to suspended sentences before January 1, 2026 will not have their inspector certificates revoked (illustrative photo).
Inspectors will have their certificates revoked in the following cases: At the same time of day, simultaneously performing inspections or confirming inspection results from 2 or more inspection facilities; Falsifying documents to obtain inspector certificates; Having been temporarily suspended from inspection 3 times within 12 consecutive months;
Convicted by a court verdict that has come into legal effect for violating regulations related to certification and inspection activities;
Use tools and software to repair vehicle data, inspection and certification data to legalize vehicle information and vehicle inspection results;
Having lost or limited civil capacity; Not directly performing professional work related to the field of vehicle inspection for 12 consecutive months or more.
The above contents take effect from January 1, 2025. The regulation that inspectors will have their certificates revoked in case they are convicted by a legally effective court judgment for violating regulations related to certification and inspection activities will apply from January 1, 2026.
Mr. Nguyen To An, Deputy Director of the Vietnam Register, shared and clarified some regulations on motor vehicle inspectors at the Conference.
Sharing more, Mr. Nguyen To An, Deputy Director of the Vietnam Register, said that Decree 121/2024 of the Government only stipulates the temporary suspension of revocation of vehicle inspector certificates for cases convicted by court verdicts that have come into effect until January 1, 2025.
However, with the above provisions in Circular 45/2024, inspectors convicted by a court verdict that has come into legal effect before January 1, 2026, will not have their inspector certificates revoked.
Thus, inspectors who were sentenced to suspended sentences (not banned from practicing according to the law) before January 1, 2026 will be allowed to continue inspecting motor vehicles at inspection facilities.
"However, if the inspector does not participate in inspection activities within 12 months, his/her inspection certificate will still be revoked according to regulations," Mr. An emphasized.
According to leaders of some inspection facilities, the above regulation has removed obstacles for inspection facilities facing the current risk of human resource shortage, creating conditions for inspectors with suspended sentences and not banned from practicing to continue working, contributing to motor vehicle inspection activities, serving the needs of people and businesses.
From January 1, 2025, motor vehicle inspectors will be divided into 3 classes instead of 2 classes as currently regulated (illustrative photo).
There will be 3 classes of inspectors
According to Mr. Nghia, currently, vehicle inspectors are divided into two classes: motor vehicle inspectors and senior motor vehicle inspectors; There are no regulations on vehicle inspectors responsible for certifying the technical safety and environmental protection quality of newly manufactured, assembled, and imported vehicles as well as inspecting emissions of motorbikes and scooters.
Current documents only stipulate that the task of certifying the technical safety and environmental protection quality of manufactured, assembled and imported vehicles is assigned to inspection officials and civil servants.
However, the Law on Road Traffic Safety and Order stipulates: The certification of technical safety and environmental protection quality of motor vehicles, specialized motorbikes, and motor vehicle spare parts in import, production, and assembly is performed by inspectors and certified by competent authorities. Inspectors are people who are granted professional certificates in certifying and inspecting motor vehicles and specialized motorbikes. Motorcycles and motorbikes only undergo emission inspection.
Implementing the provisions of the Law, in Circular 45/2024, the Ministry of Transport reclassifies motor vehicle inspectors. Accordingly, class III inspectors perform the work of inspecting emissions of motorbikes and scooters.
Class II inspectors perform specialized work in inspecting motor vehicles. Class I inspectors perform specialized work in inspecting motor vehicles.
In particular, students applying for a Class III and Class I inspection certificate do not have to do an internship. Students applying for a Class II certificate must do an internship at the inspection facility within 60 days from the date of satisfactory results on the training.
Regarding the time and volume of practice for class II inspectors, Circular 45/2024 has removed regulations on the number of passenger cars and trucks; reduced the number of vehicle records required to practice and added requirements for practicing acceptance of motor vehicle modifications.
Mr. Nguyen To An, Deputy Director of the Vietnam Register, said that disseminating and guiding the implementation of newly issued legal documents is very necessary so that registration facilities and inspectors can clearly understand the new regulations and implement them correctly and accurately.
