On the afternoon of February 5, the National Assembly Standing Committee gave opinions on the draft Resolution regulating the handling of a number of issues related to the reorganization of the state apparatus.

Presenting the Government's report, Minister of Justice Nguyen Hai Ninh said that the draft Resolution consists of 16 articles, standardizing 3 policies, including handling general and principled issues to ensure the normal operation of agencies, organizations, and units, ensuring the legitimate rights and interests of people and businesses when reorganizing the state apparatus.

Article 8 of the draft Resolution stipulates the implementation of inspection functions. Accordingly, agencies with affiliated inspection agencies and agencies assigned to perform specialized inspection functions that have changed their names or restructured their organizations without changing their functions and tasks shall continue to perform specialized inspection functions.

The General Department and equivalent organizations are reorganized into departments and equivalent organizations, and the new departments will perform the specialized inspection functions assigned to the General Department before the organizational structure is reorganized.

When a general department, department under a ministry or a ministerial-level agency is reorganized into departments, the specialized inspection function of the general department, department under a ministry or a ministerial-level agency is performed by the ministerial inspectorate.

When a general department, department under a ministry or ministerial-level agency merges with other units to form a new department, the new department will continue to perform the specialized inspection function previously assigned.

The agencies assigned to perform specialized inspection functions after being reorganized into new departments, branches and equivalent organizations, the new departments and branches will continue to perform the specialized inspection functions assigned to the departments and branches before the organizational structure reorganization.

Other cases are directly carried out by the inspection agency of the superior state administrative agency.

The newly reorganized inspection agency is responsible for reviewing and inheriting the issued inspection plans to develop and submit to the competent authority for issuance of a new inspection plan.

For inspections that are in progress or have finished but have not yet issued inspection conclusions, the inspection team shall continue to perform inspection tasks, report inspection results, and draft inspection conclusions to be submitted to the head of the newly reorganized inspection agency to issue inspection conclusions.

In case the inspection involves many contents under the state management of many newly reorganized agencies, the head of the inspection team shall prepare draft inspection conclusions according to the corresponding state management contents and report to the head of the competent inspection agency to issue the inspection conclusions.

Examining the above content, Chairman of the Law Committee Hoang Thanh Tung said that the Standing Committee of the Law Committee found that the Government is currently in the process of developing and completing a project on the arrangement of the inspection agency system.

Therefore, he suggested that the drafting agency continue to update and coordinate with relevant agencies and organizations to complete the regulations on inspection functions in the draft Resolution, ensuring compliance with the plan for organizing and arranging inspection agencies according to regulations of competent authorities.

At the same time, the examining agency also proposed to study how to express this content regulation in a more general way, suitable for the plans and situations of organizational arrangement.
