The Hanoi People's Committee has just issued Plan No. 154/KH-UBND on strengthening inspection and handling of violations in the management and use of agricultural land; handling encroachment, occupation and illegal construction on agricultural land and forest land in districts, towns and cities in the city.

Accordingly, the city has conducted inspections, checks and conclusions for 30 districts, towns and 579 wards, communes and townships related to the handling of violations in the management and use of agricultural land. However, from 2018 to now, the handling and correction of violations has only reached about 50% of the violations that need to be handled. Some localities still let new violations arise without timely measures to prevent them, and some localities let violations in forest land management and illegal construction occur but have not had definitive measures to handle them.

On March 28, 2023, the Party Committee of the City People's Committee issued Document No. 158/CV/BCSĐ, in which it was determined that there was still encroachment and construction on agricultural land and forest land that had not been effectively prevented and handled, causing public outrage.

Therefore, the Hanoi People's Committee requests to thoroughly handle all violations regarding agricultural land, public agricultural land and public land that have been concluded by the Department of Natural Resources and Environment for inspection. The City People's Committee has directed to handle them in Documents No. 5735/UBND-DT dated December 26, 2019; Document No. 3232/UBND-DT dated September 27, 2021; Document No. 847/UBND-TNMT dated March 28, 2023.

The Hanoi People's Committee assigned the Department of Natural Resources and Environment to preside over and coordinate with relevant departments and branches to organize inspections of the implementation of inspection conclusions, guide and urge the People's Committees of districts, towns and cities to organize handling and remedy of violations listed in the inspection conclusions, and apply measures and solutions directed by the City People's Committee;

The Department of Planning and Architecture coordinates in providing information on construction planning for the People's Committees of districts, towns and cities to handle and remedy violations mentioned in the inspection conclusions; organizes the review of unplanned areas and coordinates in guiding the People's Committees of districts, towns and cities to handle violations in unplanned areas according to the provisions of law;

The Department of Agriculture and Rural Development shall preside over, coordinate and guide the People's Committees of districts, towns and cities to handle cases of using agricultural land for livestock and crop farming purposes in accordance with the guiding criteria of the Ministry of Agriculture and Rural Development;

The Department of Home Affairs shall preside over and coordinate with relevant departments and branches to develop regulations and rules to submit to the City People's Committee to clearly assign responsibilities for implementation and coordination of agencies, organizations and individuals in land management and construction order, especially specialized agencies under the district-level People's Committee and specialized staff under the commune-level People's Committee; in which clearly stipulate the handling process and forms of handling for collectives and individuals who commit land and construction violations that are not promptly handled in accordance with the provisions of law;

The Department of Justice shall preside over the inspection and guidance of the People's Committees of districts, towns and communes, wards and townships in applying the law on handling administrative violations in the fields of land and construction order when handling cases and violations on agricultural land according to inspection conclusions.

The People's Committees of districts, towns and cities continue to resolutely organize and apply synchronous solutions to thoroughly handle violations in the management and use of agricultural land according to the provisions of law and the instructions of the City People's Committee regarding violations pointed out in the inspection conclusion regarding agricultural land and public agricultural land.

Hanoi City requests the People's Committees of districts, towns and cities to organize the handling and remedy of violations mentioned in the inspection conclusions, report the implementation results to the Department of Natural Resources and Environment for synthesis and reporting to the City People's Committee before November 15, 2024.
