Candidates for the selection of People's Court Judges who intentionally cause insecurity and disorder, affecting the examination room, in addition to being suspended or having their exam results canceled, depending on the nature and severity, will also be handled according to the provisions of criminal law.
This is one of the notable contents in the draft Circular regulating the examination for selection of People's Court Judges that this agency is seeking comments on.
This draft stipulates that the selection of judges is conducted at least once a year according to the principle of competition, ensuring a strict, transparent, public, fair and democratic process to select those who meet the conditions and standards to propose appointment as People's Court judges.
The draft stipulates the subjects of the exam: Civil servants working in the People's Court and Military Court at all levels who meet the conditions and standards have the right to register to take the exam to select Judges of the People's Court.
According to the draft, every year, based on the assigned staff of agencies and units in the People's Court, the Department of Organization and Personnel reviews the number of judges of the People's Court and Military Courts at all levels to determine the number of judges that need to be supplemented in the working year; determines the conditions and criteria for each judge selection exam and develops a judge selection exam plan, submits it to the Chief Justice of the Supreme People's Court for consideration and decision.
Candidates must meet the prescribed conditions and standards and have at least 6 years of working experience from the date of registration. In addition to ensuring the above regulations, candidates must meet other conditions prescribed by the Chief Justice of the Supreme People's Court for each examination.
Candidates who pass the judge selection exam must meet all the conditions. Specifically, they must have a score of 50 points or more in each part of the exam and a total score of the exam parts, taken in descending order within the assigned judge quota. In case part 2 is a written exam combined with an interview, the score for each exam form must be 50% or more of the total score for each exam form.
In case there are 2 or more people with the same final score, the successful candidate is the one with the higher score in Part 2. If the scores in Part 2 are equal, the Chairman of the Examination Council will consider and decide the successful candidate.
The selection results are valid for consideration and recommendation for appointment as judge.
The draft also provides regulations strictly prohibiting any act of copying or transmitting information related to the exam outside the exam room or receiving information from outside into the exam room.
Candidates who intentionally cause insecurity and disorder in the examination room, in addition to being suspended or having their exam results canceled, depending on the nature and severity, will also be handled according to the provisions of criminal law.
In addition, if a candidate is suspended from the exam or has his/her exam results canceled, the head of the competent management agency or unit will consider and handle disciplinary action according to the provisions of the law on cadres, civil servants, and public employees.
In case the exam room supervisor reveals the exam questions, transfers the exam papers outside, or transfers the answers from outside into the exam room, the chairman of the examination council will suspend the supervisor's duties.
In case of serious violations that affect the exam results, disciplinary action will be considered according to regulations for cadres, civil servants, and public employees or prosecuted according to the provisions of law.
