The People's Committee of Da Nang City has just decided on the land use limit for individuals in rural and urban areas with the lowest level being 100m2 in some wards in Hai Chau district, and the highest land use limit being 300m2 in some communes of Hoa Vang district and Hoang Sa district.
Accordingly, in Hai Chau district, the land allocation limit for individuals in Hoa Cuong Bac and Hoa Cuong Nam wards is 150m2; the remaining wards are 100m2. The land allocation limit for individuals in An Khe, Hoa Khe, Thanh Khe Dong and Thanh Khe Tay wards (Thanh Khe district) is 150m2; the remaining wards are 100m2.
In Son Tra district, the limit for residential land allocation to individuals in all wards is 150m2. For the case of using land in front of the streets: Le Van Hien, Tran Dai Nghia and 2 wards My An, Khue My (Ngu Hanh Son district), the limit for residential land allocation to individuals is 150m2. The remaining locations of Hoa Quy and Hoa Hai wards are 200m2.
For the case of land use in locations facing the following streets: Ton Duc Thang, Nguyen Luong Bang, Nguyen Van Cu, Au Co, Hai Van - Tuy Loan bypass (Lien Chieu district), the land allocation limit for individuals is 150m2. The remaining locations have a land allocation limit for individuals of 200m2.
In Cam Le District, Khue Trung Ward and in the case of land use at the frontage of the following streets: Truong Chinh (the side without railway), Ton Duc Thang, Cach Mang Thang 8, Truong Son, the land allocation limit for individuals is 150m2. The remaining locations are 200m2.
In Hoa Vang District, the limit for residential land allocation to individuals in the case of land use in locations facing the following roads: National Highway 1A, National Highway 14B, Truong Son, National Highway 14G, DT 601 (section belonging to Hoa Son commune), DT 602, DT 605, Hoa Lien - Tuy Loan expressway, Hoang Van Thai extension, Hoa Phuoc - Hoa Khuong, Western Ring Road is 150m2.
The limit for residential land allocation to individuals in the remaining locations of Hoa Phuoc, Hoa Chau, Hoa Tien, Hoa Nhon, Hoa Phong, Hoa Khuong, Hoa Son, and Hoa Lien communes is 200 square meters; the remaining locations of Hoa Bac, Hoa Phu, and Hoa Ninh communes is 300 square meters. The limit for residential land allocation to individuals in Hoang Sa district is 300 square meters.
According to Decision No. 32/2024/QD-UBND dated October 7, 2024, the limit for allocation of unused land to individuals for use according to the planning and land use plan approved by competent authorities for planting annual crops and perennial crops shall not exceed 1,000m2 for each type of land. The limit for allocation of land for aquaculture and salt production shall not exceed 5,000m2. The limit for allocation of land for planting production forests shall not exceed 20,000m2.
The limit for receiving the transfer of agricultural land use rights of an individual shall not exceed 10 times the limit for agricultural land allocation of an individual for each type of land prescribed in the Land Law.
The limit for recognizing residential land when granting a Certificate of land use rights and ownership of assets attached to land is calculated according to the provisions of Article 141 of the Land Law.
Specifically, in the case of a land plot formed before December 18, 1980, the residential land recognition limit is determined to be 10 times the residential land allocation limit prescribed in Decision No. 32/2024/QD-UBND dated October 7, 2024; in the case of a land plot formed from December 18, 1980 to before October 15, 1993, the residential land recognition limit is determined to be 2 times the residential land allocation limit prescribed in Decision No. 32/2024/QD-UBND dated October 7, 2024.
